Valiant homes Auckland are not paying contractors invoices and are leaving bad debts all over Auckland. The Directors Hamish Clarke and Sam Tolich are fabricating disputes to delay legal action. Builders, Blocklayers, Painters, Scaffolders, Kitchen installers, Draftsman,  Roofers, Steel fabricators and more are outstanding creditors. They are trying to escape their cashflow problems by leaving debts with past contractors and engaging new contractors

Hamish James Clarke have put Valiant homes into liquidation leaving many suppliers, subcontractors and employees hundreds of thousands of dollars out of pocket. Samuel Francis Tolich and Hamish James Clarke have misled suppliers, subcontractors and suppliers for more than a year trading insolvent.

Work has stopped this week at valiant homes sites and scaffolding and unpaid subcontractors have been removing materials. Sam Tolich and Hamish James Clarke have left many subcontractors with unpaid invoices and large legal bills. They have continued to trade while insolvent by engaging new contractors without paying previous contractors. A few of the current projects have had 3 scaffold companies erect then dismantle scaffold due to non payment, a fourth previous company still awaits payment but is just lied to by Sam Tolich. Report to serious fraud office and in event of liquidation Sam Tolich and Hamish Clarke will be liable for reckless trading making them personally liable and unable to hide behind shell companies

What part of original report is defamatory? none because the report is true.

It was indeed written by a very aggreived former subcontractor who is owed alot of money. One of many former contractors ,employees and suppliers. Trying to paint the picture as a dispute with a single (or even a few) contractors is pure fantasy. At least 3 building companies, 2 gib fixing contractors, 2 scaffold companies, 3 former employees, 2 roofing companies, blocklayers, painters, kitchen installers and plumbers have not been paid. Some of the debts go back as far as last year.

Valiant has not attempted to resolve their non payment in good faith, promises have been made of payments but no results. Creditors have been lied to and the directors have been cynical and reckless in the way they are trading.

Creditors are owed hundreds of thousands of dollars and will be holding a creditors meeting soon. Hamish Clarke and Sam Tolich will be invited to give notice to creditors of risks been taken with their funds or of a payment proposal. Notice of meeting will be given in the Herald ,NBR and Chinese newspapers.

The recent NZ High Court judgement for Complete Siteworks vs Watts and Hughes Construction has clarified the Construction Contracts Act(NZ) and its key provisions that subcontractors have to be paid even if there is a dispute and that disputes are to be sorted retrospectively. This is to avoid the all to common occurrence of lead contractors using disputes to withold payments when solvency is an issue.

The original report couldnt possibly have damaged the reputation of a company with such a credit history and more media outlets are showing interest in getting the truth out so stay tuned.

Unfortunately, it has come to our attention that an anonymous party has posted defamatory remarks regarding our business on an international website, a public forum.

As we take our business, and reputation, seriously, we feel it appropriate to respond to this posting, even if done in a non-transparent manner intended to cause harm to our business without accountability.

We note for the record that we are fairly confident that the party who made this posting is a disgruntled sub-contractor with whom we are currently in a formal dispute process.  Why are we in a disputes process with this party?  Simply, because they have not fulfilled their obligations to us regarding completion and workmanship.  Furthermore, said party has attempted to claim works outside of our contracts without proper authorisation or procedure, notwithstanding having been on notice of this. Payment under any commercial agreement is dependent upon performance and following the commercial rules of the relationship, basic commercial principles that this party willingly chooses to ignore.

For the record, Valiant has attempted to settle and resolve this dispute in good faith, and will continue to do so.  However, resolution of any such matter always requires two parties to act, and we continue to await a considered approach from said party.
