Wildhorse Estates revised there lease and never told anyone. Before you had to give a 30 day notice, now its a 60 day notice and if you move out before the 60 days they charge you an additional $1,000.00 on top of your rent. You still have to pay your last months rent but they will prorate it. For example, if your move out date is the 26th, they will prorate it for that date but you still have to pay it plus the rent for your new place. They also wont give you your security deposit back even if you leave the place in better shape than you moved in.

Lease?

AUTHOR: Mike - (U.S.A.)

POSTED: Saturday, October 15, 2011

A landlord can NOT just change a lease mid-term.  So the only way they could have changed it to a 60 day notice is if it was in the last lease you signed.  If it is in there the one at fault is you for not reading what you are signing.  Now if you didn't sign a new lease and went to a month-to-month they may be able to change it but would have had to notify you.

You still have to pay your last months rent but they will prorate it.
For example, if your move out date is the 26th, they will prorate it for that date but you still have to pay it plus the rent for your new place.
- That's standard.  Because you have not moved out yet.  If you want to avoid this you need either move out sooner or don't "move in" to your new place until a later date.

They also wont give you your security deposit back even if you leave the place in better shape than you moved in.

- There are specific laws dealing with security deposits.  You need to look those up and if they are not followed you may have a valid claim to not only get your deposit back but additional damages.
