I am not a bank one customer. However My name is Eric Lewis. There are other peple with that name it is quiet common. There is another Eric Lewis who lives about 45 miles from my house, and he has a Bank One credit card. Obvoiusly he has not paid his bills and had his phone turnded off. He continues not to pay his bills.
This is where the problem is. Bank one looked up my phone number and has been calling me ever few days trying to get paid.
Each time I talk to them I give them the information that they need and they tell me they will remove my phone number from their system. Then I get another call, and another call and another call.
This is harrasment pure and simple and I am not even the correct Eric Lewis.
So what should I do, anybody got any good ideas.

First: Write them a letter, don't be polite, and tell them that they have the wrong person, these phone calls are harassing and demand, don't ask, DEMAND that they stop.
Second: File a complaint with the local phone company. Local phone companies have varying policies on whether to call the phone company or the police first. Other phone companies may require you to file a formal complaint with local law enforcement before they will deal with the matter. To find out what your phone company's policy is, contact the business office and ask for assistance.
Third: Go to your police department and file a harassment complaint against the bank. Name the local branch manager along with the CEO of the bank.
Fourth: file a complaint with your state banking commission.
If this doesn't get thier attention your only other step is to sue them. I would try small claims court. For Alabama, the limit is $3000.

If that doesnt work, you need to hire a lawyer and go after them.
