I've been working on a modification with these people for the last year and a half. I submitted full paperwork no less than three times and finally got some help when I involved the State of Michigan. I received HAMP funds and a new payment but now not only are my new payments not being recorded, they're sending foreclosure notices based on not receiving the amount of the old payment. There's ONE 800 number that rings at a call center but you can't get past them to get any real help. Is this a scam company? Does anybody know what's going on here?

My name is Sarah, I am replying to you because saw your comment reply about Caliber Home Loans being involved with your mortgage company. I work for a company that deals with these types Caliber Home Loans have been one of the names that has been coming up a whole lot lately. It seems they are involved with a ton of fraudulent loans.

We will be able to advise,consult and educate you. You may be able to receive the compensation you deserve due to the negligence of the lenders involved. It is your obligation to yourself to use your last means of defense to get to the truth of this matter.  Once you provide evidence that they have been collecting on your property illegally you can take it to court and petition to void the deed of trust.

 

When and/if your property is being foreclosed on one of the things we do offer is a packet for a Stay of Execution which has stopped at least two of our clients from losing their homes until we were able to finish the investigation for them.

All Lenders are must produce the Documents required by Law to prove ownership of the loan. This is called Validation.

You are getting great suggestions, but unfortunately.....

...I would not count on them working.

 

I have been dealing with Caliber for going on two years.  In the time I have been dealing with them, I have sent at least 10 QWRs, disputed too many times to count over the phone, and even spoken with the attorney that they claim represents them.  The whole thing is a total scam. 

 

First, the QWRs.  It is true that the law requires Caliber to acknowledge your QWR within 5 days and respond to it within 30.  But do not count on this actually working, because if they commit a "pattern of noncompliance" under that law, known as RESPA, you can sue them for $2000 in statutory damages plus any actual damages.  What sense does that even make?  We're dealing with mortgages here--if they get sued for $2K, it's nothing for them considering the average principal balance owed on a mortgage today.  The law does not have any real teeth to discourage servicers like Caliber from breaking it.

 

Next, you can file reports with the CFPB.  This is also a waste of time in most cases.  I went this route as well.  I filed a complaint against Caliber earlier this year.  Caliber responded with a total fabrication.  I disputed their response and provided documentation FROM CALIBER showing that they were lying to the CFPB.  Nothing ever came of the dispute.

 

And then, in most states, the courts wont even help because the judges ignore laws relevant to the issue, such as the UCC, which is law in every state but courts most often ignore it and proceed against the homeowner anyways.  Calber has told me that several different parties supposedly own this loan, at the same time.  I cannot get a straight answer about anything from them.  In most courts, if you defaulted on the mortgage, they do not even care if the plaintiff that's trying to foreclose is the right party, they foreclose anyways.  I've actually seen videos of hearings where the judge says to the homeowner, "well, you say they do not own the loan but you have offered nothing to show that they do not own it.  And even if you are unsure, someone owns it, so it might as well be the plaintiff..."  Im not kidding.  Keep in mind, in court, its not the defendant's job to prove that the plaintiff does not have a case, it's the plaintiff's job to prove that they do have one.  But again, courts are ignoring this far and wide.

 

I really wish I had better answers for you, but if I did, my own battle would be over as well.  I am not recommending that you do not do the things that have been suggested, by all means I recommend that you do them.  Just do not be fooled into thinking that they will solve the problem, because historically they have not provided much.  You might consider contacting the same people in the State of Michigan that you spoke with about the HAMP help previously, they might have an idea on how to get someone involved.

I have had many dealings with Caliber Home Loans and can completely validate your complaints. I commend you for contacting the state of Michigan, as that is an excellent and important step in asserting your consumer rights. 

You have so many consumer rights and consumer protections under the FDCPA and the CFPB and the FTC and RESPA with regard to your complaint and it only takes a few minutes to submit the complaints online to the CFPB and FTC for an immediate response and action.

In fact, we covered your complaint today on our radio show The Daily Complaint and provided a pathway for success to include how to contact the CFPB - thank you for posting your complaint online via the Ripoff Report so that others will have the opportunity to learn from your experiences in dealing with Caliber Home Loans. There are firm rules in place with regard to the posting of your payments during the MHA HAMP trial period plan and also to moving forward with foreclosure but again, you must know your rights in order to exercise your rights.

In addition to submitting complaints to the CFPB, I would suggest preparing a QWR for Caliber Home Loans – you can learn how through the CFPB by typing in QWR in their search bar. They are required to acknowledge the QWR per RESPA in 5 business days and answer it in 30 business days or you do have recourse, so listen to us address your complaint on The Daily Complaint today and contact us if you need further information on how to not only attack your problem but to get the solutions that you are seeking. You can hold Caliber Home Loans accountable for their actions!
