DS Waters of America Sparklets Water Scammed into a Unknown Contract Hayward , California

So for the past 2 months i have been dealing with at first (sparklet. Water) i had there service as i was in a month to month prepaid arrangement (not a contract) with my debit card. they were suppose to give me 2 months free for the cooler and 2 bottles a month at the price of 4.99 each however, we had moved so i contacted them to close the account. the lady i spoke with told me i couldn't cancel because i was in a one year contract!! I specifically told her i dont see how i would be in a one year contract considering i hate signing contracts and i would never do contracts with company's like them. She then told me i signed a whole contract. I specifically said then show me the proof. (because i only signed an agreement paper saying the delivery driver dropped off the equipment.) "so i thought" she then e-mailed me this paper that i do remember signing but was told that it was just for dropping off the equipment however nothing was checked off but the delivery driver said look i will go over this with you to show you it is NOT a contract so me and my husband then agreed to this. He showed me were it says he dropped off 2 bottles and a temporary cooler because he did not have the one i originally wanted. So since he clarified it was not a contract me and husband agreed to do this non contract plan for water. So as we went over the information again with the driver for clarification i could cancel anytime no contract and it was automatically taken off my debit card. monthly bill amount would be about $32month well as i was speaking to the lady on the phone going over this "contract" i signed i said well yes but none of those boxes that are checked in for the 1 year agreement were checked in to begin with!!! so he checked in a one year agreement after i signed the paper!!! however i didn't have the copy of the paper that i signed "unfortunately" because he never gave me a copy!!! so here is this paper i signed thinking its stating yes he delivered this equipment to my place. instead he checks off one year agreement and everything else!! so yes i was pretty pissed at this point.. now i have to pay cancelation fee's late fee's for whatever reasons and miscellaneous charges that they refuse to break down to me. so I finally got ahold of someone at sparklettes that i could understand (english) and we worked out a deal for me to pay 124.47 and never have to worry about this place again and be done with them... well... then 1 week before i make the payment i get a letter from DS Waters of America Inc. and they are stating i need to contact them within 5 days or make the payment in full.. so i called that monday morning to get this straight because i have an arrangement to pay 124.47 ( the bill i got in the mail is for a total of 175.99)  Now all of a sudden i owe this much???? i spoke to the lady a DS waters she tells me well that agreement will not be in place anymore and now my total balance as of today is 176.54 i asked why is it this much but on this paper bill i have 175.99 she stated to me that there is interest... so i asked her is there daily interest on this or what? she responded to yes. 1.7% DAILY interest... Daily interest on a stupid water bill????? so i said fine lets make an arrangement once again and i want to pay this in full but i SPECIFICALLY repeated to her for May 14th, 2011 to take out the total balance due and i asked what the balance due would be.. she then says 184.64 would be the total amount taken out may 14th then by debit transaction. I said ok and now you will be sending me a letter in the mail saying paid in full and that it did not report back to the credit bureau yet. she said yes a letter will be sent and the payment of 184.64 will be charged off your account on may 14th. so this was the agreement. well i check my checking account this morning and there is a charge of 184.64 from DS Waters This is only April 26th!!! transaction was post dated for may 14th!!! so i was soo mad i have been calling all day long trying to get ahold of this Manager who was suppose to be in at 8am and left her a voicemail because the lady i spoke with said she would call me right back and that she see's on the account that it was suppose to be taken may 14th and not yesterday so they are such scammers and rip offs i dont know what to do!!! now i owe my bank insificient fund fee's and the total amount they took out of my account because they did an unauthorized transaction set on the wrong date but now i can't do anything about it except pay it.. as i told the lady the funds will be available may 14th for a reason because thats a payday!!! Good luck and advise you to never ever get water from this company and dont ever sign anything !!! contracts only if you want to be in one.. besides that stay away or you will end up paying...
