In late February 2013 my wife and I purchased a 2007 Mini Cooper from Gibson Truck World. We were told we would be purchasing the vehicle "As Is" and signed a document stating such. After we agreed to the purchase of the vehicle we went to the "finance office" to sign the paperwork where we were offered the warranty on the used car and were assured that "this is like a new car warranty, it will cover everything but normal wear and tear." We were given the option of 3 different levels Bronze, Silver, and Gold.

Obviously we went with the best coverage since we were purchasing an older vehicle. I specifically asked about clutch problems and was told not if it's considered normal wear on the car but if not the yes it will be covered. After I got the car home I noticed small issues with the car I.E. the sun roof fabric was torn on the edges, the driver side visor mirror cover was missing and the visor was dirty. I also noticed that the passenger side mirror falls completely out when you put the visor down. Small things that did not affect the way the vehicle ran so it was not an issue.

Wednesday July 24th I drove to Oviedo, FL to take my son to his therapy appointment and when I got out at 4:30 my car would not start. I used my own means to have the car towed to my home 27 miles away. The following day I contacted the warranty company and they towed it to the local Mini Cooper dealership but the mileage was over the limit given so I had to pay an additional 18.00. The following Tuesday, July 30th I received a call from the Mini dealership stating that the ELV (Electronic Locking Mechanism) inside the steering column was bad and needed to be replaced and was told per the warranty company that was not covered.

The repair is 610.00 219.00 was the cost of the part and the rest was labor PLUS TAX! I said don't fix the car I was told everything was covered but normal wear and tear. Gary at Orlando Mini verified that this was indeed NOT a normal wear item. I called the Warranty company myself and sure enough was told that the part nor labor was covered. So later that day I called and spoke with the person, Hector, who sold me the "Like New Car Warranty" and was told that there's nothing he could do but refund the money for the warranty back to the bank in which the car was financed leaving me with a 600.00 plus tax repair on my car.

I explained to Hector that I needed a check for the warranty costs since the money in the bank didn't help me get my car out of the shop. By this time it's now Friday Aug 2. He said he'd have to check with the manager to see if that could be done. I said FINE call me back I need my car by Monday morning. Friday night I heard nothing, Saturday I called and left a message and didn't hear back. Sunday I called and left a message and by Tuesday Aug 6 I STILL HAD NOT HEARD ANYTHING BACK.

So by this time it has been two weeks that I had not had a car and have had to ask favors from friends and family to help me with my normal day to day errands. I requested that Gibson Truck World either pays the difference for me to get my car fixed, I have a 100.00 deductible that I'm willing to pay. Or to give me the price of my warranty back in the form of a check. The cost of the warranty has already incrued finance charged and interest at BB&T where the car is financed through so I just want the money or for the car's repairs to be paid for.

This is also what I discussed with Hector and heard nothing back. Finally I needed my car back and since it was clear that Gibson was not going to call me back I had no other choice than to borrow the money from my family to get the car fixed. I called Mini back and told them to move forward with the repair and I would just pay for it myself. So they had it repaired fairly quickly and took it for a test drive.

 
The odd noise I told him I was hearing before it broke down was because the car NEEDED A WHOLE NEW TRANSMISSION, they had to fix the first problem so the car would run enough to find out what the second issue was. So my car needed a new transmission, which is not new it was used that the warranty paid for but still I paid my 100.00 deductible so my total bill after everything was 860.00. Gibson said they had their mechanic look it over and he didn't see any issues with the car and it was running like new. So I finally get my car back after it being in the shop for almost a month. Several weeks (about 6 to 8) later I start hearing this awful noise again.
 
I tried to ignore it because the car didn't seem to run any different. Then an error light came on which was the Exhaust Emissions light, so I decided it'd take the car into the shop in a few days once I got the money to fix it. That next day I went to drive it to work and the car was not running right, I'd press on the gas but the car would not hardly go. SO I called and made an appointment and took the car in on Wednesday October 9th. I told them what was wrong with it and they mentioned that my car also needed rear brakes that would cost me 260.00.
 
I told them to wait on the brakes but call me with the issue with the engine. Come to find out my camshaft sensor needed to be replaced. So they replaced it and the warranty did cover it so I paid my 100.00 deductible plus I paid for an oil change and a 10.00 part that the warranty would not pay for. I am researching FL lemon law and contacting an attorney to fight Gibson Truck World in reference to this terrible piece of junk they sold me. I will NEVER shop there again nor will I ever recommend them to anyone, not even my worst enemy.

I was told that the warranty was like a new car warranty and would covery EVERYTHING but normal wear items. I verifyed that the original probleam was NOT a normal wear item but a factory defect and that it should be covered. The people who work at this place are nothing but a bunch of liars and I will stop at nothing to ensure that this dealership knows how bad they've screwed me. My next visit is to the DMV.

The "Lemon Law" applies only to NEW cars.  What you have here is a car with problems, some of which are covered under warranty and some aren't.  It is to the advantage of the warranty company to deny everything.  They are hoping you are too stupid to do your own research.  I would suggest you read the warranty paperwork yourself to find out what is covered and what isn't.  When the warranty company denies coverage, get an explanation.  The only legal alternative you have here is if the warranty company tells you a lie.
