Samual Scott owned three (3) UPS stores in Port Charlotte, Florida and refused to take responsibility when we first leased a mail box from him and gave us the wrong address, which obviously caused a reprint on brochures and business cards. Then he decided to close the store that we were using right after we renued our 1 year lease for the mail box. He refuses to refund any funds and says he has no money.

Vendors and suppliers beware.

Bottom line, the contract states that there is no proration or refunds for a mailbox agreement. That statement generally refers to a box holder that prematurely chooses to close a box. The store itself closing, though a unique scenario, would also apply.

The fact that this owner closed soon after renewing the box would seem to indicate that he new he was taking funds for a service he would not provide. Assuming that is the case, fraud would be the complaint.

Considering the owner has two other store locations, presumably not too far from the location you had your address at, he could have offered you some options. First of all, he has two other store locations, so he has money. Secondly, he could offer openning another mailbox for you at one of the other locations at no charge, plus give you several free additional months in an attempt to accomodate for your inconvenience and costs.

If the owner does not offer these options, or any others, you could file in small claims court considering, again, he is still in business with the other locations. The odds are small that you'd win, but it would be worth the shot. If he doesn't make right to you, his other locations will also suffer due to his habits.
