 I had bought my car in April 2009 on  66 month agreemnet paying around 300 dolalrs a month. In 2010 I lost my job and could not afford to make the payments. My car got repoed. It was around tax season, so I used my tax return to pay the towing company and fifth third bank to become current on all my payments. I was told to get my car back I would have to pay the money for the months I missed plus interest to become current. So I paid the amount to get my car back. I have not missed a payment since i may have been a couple days late paying it on the due date but I never went over my grace period. In November 2014, it was my 66th month, so I sent in my monthly amount About 2 weeks, later I get a bill from Fifth Third Bank stating that I still owe over 3,000 dollars. I called them immediately. They told me that its because of the repoe and the interest of late charges. I told them that it was the payments are current when I paid the amount back in 2010 to get my car back. I asked for them to send me a summary of my payment activity. I got the payment summary a couple weeks later, I noticed that they were charging me late interest fees before my grace period. I had to make payments by 23rd of each month, my grace peiod was on the 8th of the follwoing month, so i have until then to pay until they start charing my late interest. However, some months I would pay my on the 26th, and then have a late interest fee dated on the 7th of the following month. I called back upset about them charging my extra before my grace period. However they were very rude and continue to harass me for the 3,000 dollars, I refuse to pay because I became current after my repoed. I dont know what to do.

Why do people always feel the need to exaggerate..

First of all you come here giving your entire story where you "dont know what to do".  Then as soon as someone posts something you don't agree with you are not only all of the sudden someone who knows your "rights", but amazingly knows how everything works because you are in the "car business world" (what ever that means).

Well if all that was true...why did you first come here saying you don't know what to do.  It just doesn't match up.  If that doesn't add up, then one has to think about what else in your report doesn't add up either.

So here is some things for you.  First of all there is not really any grace periods.  If you have a payment due on the 23rd, you are late on the 24th.  Now, there are companies that will give you a period of time before they assess late payment FEES, which this is NOT the same as INTEREST.  Your loan was based on you making a certain payment, for a certain amount, on a certain date every month.  So some loans will also start to charge you additional interest after the due date, or some may split it up where you are charged additional interest after something like 5 days, but not charged a late FEE until something like 10 days.

As for what you are calling a Grace Period, you apparently have/had 15 days.  In all honestly that is actually excellent as the average loan will be in the 5-10 day range.  One reason I bring this up is that there is a possibility that when you got your car back one of the conditions you didn't list here is that they changed the penalties making them more restrictive as the 15-day is for people with better history than you now have.  Did you sign any other sort of agreements that may have had these changes?

Are you sure you actually paid ALL of the past due amounts and were exactly current after the repo?

You also made an interesting statement about how on "some" months you paid them on the 26th.  So are we to take that as on the other months you paid them on or before the due date, or that on some months you also paid them later?  As it doesn't matter when you send the payment, it matters when they receive it. 

$3,000 is quite a bit of lateness, so just how many months in the 4 1/2(or so) years after the repo did you pay them after the due date?  Does their payment history agree with yours in terms of the dates and amounts(keeping in mind that it only counts as to when they receive it)?

Now of course no one here knows what your contract exactly states or the exact payment history you are claiming, all we have is what you are telling us. 

Oh and even though that you are in the "car business world" and already know everything...just be aware that if you have a past due balance with them and continue to refuse to pay it..they still have the legal right to reposess your car again.

Is it possible that the repo had an effect on the grace period??? That is, since the car was repoed, the company did away with the grace period or moved up the payment date???

No the grace period is a legal thibg however, when u pass that grace period the monthly payment goes which i don't have a problem with but they are tacking more late fee charges if i dont pay on the due date. Its MY life and i know MY rights bc wait i work in the car business world and I know how things work. But thank u for caring so much about MY life

 First, there is NO LEGAL grace period. It is done as a courtesy but there is NO LAW that states they HAVE to give YOU this extra time .If your bill was due on a specific date, then YOU pay it after that date, THEY are well within their legal rights to charge YOU a late fee. It always amazes me to think how much the self entitled consumer takes advantage of ANY situation. What makes YOU different then EVERYONE ELSE that YOU shouldn't be charged a late fee when you are paying your bill LATE!!! So due to YOUR accounting practices and YOUR bill paying practices, THEY are the bad guys because THEY want their money. How does that work exactly?? DO you just put your head in the sand until a problem comes up?? Its NOT their fault that YOU just cannot pay your bill WHEN it is due!! Its nothing more then YOU and how YOU handle YOUR money and bills. To blame THEM because A. You couldn't afford the vehicle outright. B. You lost your job. C.You couldn't make your payment in the time frame needed to avoid late fees. D. YOU couldn't be bothered to at least once a year examine your loan statement. While Im sure YOU have not only justified your late payments, but making this post makes YOU feel better about your inability to handle your business because YOU get to place the blame on someone else instead of accepting responsibility that IS YOURS. The reality is that YOU had a much larger role in this situation and YOU are just passing the buck. Pay your bills ontime and YOU wont have late fees. Pretty simple really. YOU have to do the ADULT thing and make HARD CHOICES!! Sometime you don't get to eat well because YOU need to pay a bill. Its called LIFE!!!! So YOU go right ahead and continue to refuse to pay what YOU rightfully owe. Im sure YOUR credit report can take ANOTHER repossession hit. Im sure the 66 months of paying the car off means NOTHING to you because YOU choose to try and stand on shakey principles. Its YOUR life, its YOUR finances, its YOUR car. YOU get to choose what is going to happen to YOU next. Either work within their system and get this resolved, or don't and get the car repoed. YOUR CHOICE!!!
