Lately I have been receiving up to 5 phone calls per day from 1st Credit of America about a debt that I do not feel I owe. I knew nothing about their debt and at first thought they were medical bill collectors until they explained what this was for.

Once I told them I did not owe this and knew nothing about it they kept persisting that I give them my credit card number to pay the debt then and there. Even after I requested time to investigate the matter myself, they would not leave me alone.

Even to this day, SUNDAY of all days, they have already called me at 8:30 am this morning. I have currently set up my phone system to reject their calls but I have to be at my computer to dislodge their call. The recording tells them to remove my number from their list and not to call again but they refuse to accept that.

The debt is not even $100, they told me it was 80 something but that they would accept a flat 60 to take care of it now. They have threatened to tell my employer about the debt and set up wage garnishing, they have threatened me with court and attorney fees and they have rudely hung up on me as I did not do this to them. Even after asking for proof of this debt, they refused to give it to me. I am sick of this!

#2 Consumer Suggestion

You can stop these vultures from calling easily

AUTHOR: Jim - (U.S.A.)

POSTED: Friday, February 23, 2007

Calling repeatedly is against the law, don't get mad, get even, turning the tables on the harrassers is easy, here's how.

The next time these rude vultures call, the second you realize who they are press and hold the #1 button on your phone, this sends a piercing squeal through the line to their headphones they'll hang up very fast, do this every time they call to harrass you, it turns the tables back on the harrassers, they only want to harass you, when you harass them back they think it's "Unfair"

I actually had a vulture say "You can't stop me from calling" I answered "Maybe not, but I can make you wish you'd never called" (As of now, two months later, she has not called again)

It works beautifully.

TELL THEM TO VALIDATE THE CLAIM

AUTHOR: P - (U.S.A.)

POSTED: Monday, February 05, 2007

GENERAL INFORMATION FROM VARIOUS SITES ON DEALING WITH COLLECTION AGENCY'S

Tell them to validate by

. What the money you say I owe is for;
Explain and show me how you calculated what you say I owe;
Provide me with copies of any papers that show I agreed to pay what you say I owe;
Provide a verification or copy of any judgment if applicable;
Identify the original creditor;
Prove the Statute of Limitations has not expired on this account
Show me that you are licensed to collect in my state
Provide me with your license numbers and Registered Agent

1. NEVER talk to a collection agency on the phone. Period.
2. Keep good records. This can be the difference between a good and bad settlement. Don't expect them to remember you or what you agreed upon.
3. Send all correspondence via registered mail, receipt requested and put the registered mail number ON THE LETTER. DO NOT SIGN THE LETTER TYPE YOUR NAME
4. Keep a copy of every letter you send.
5. Penalties and extra interest are typically fictious amounts of money added on by the collection agency to pad their profits. Sometimes as much as to 50% of the debt or more claimed to be owed by a collection agency consisting of interest and fees. This is illegal, every state has usery laws (which dictate the maximum interests allowed to be charged. That is except North Dakota. There are no such laws which is why most credit card companies incorporate there.) Junk debt buyer pay anywhere from 1 cent to 7 cents on the dollar, there is no way there is this much interest.
