I signed up with Knuckle-Up (KU) in Atlanta, Ga. They are a kick-boxing/fitness organization. Very nice people. Unfortunately I injured a knee and was Unable to attend classes. I went to one class in a year but did not cancel my membership. However, after one year they automatically re-upped my membership and kept drafting my AMEX card. I called Knuckle-Up and advised them that I wanted to discontinue membership. That's when the horror story begins.

ASF International is the financial management firm that handles billing for Knuckle-up. The phone number that I was given by KU required that a special code be keyed in, a code number that I did not have. I called KU back and they were unable to supply me with another number to contact to cancel membership.

After becoming frustrated with not being able to contact ASF I called Amex and instructed them to disallow any billing of my account by ASF; they complied and sent ASF a written notice of my decision to discontinue membership.

About two weeks later I received a bill from ASF for $49. Located on the invoice was a telephone number to ASF different than the one supplied by KU. I called that number numerous times and was placed on hold for 30 minutes or more each time. When I was finally put in touch with a human I advised them that I had discontinued my membership and had stopped all payments; that I had attempted to contact ASF by phone and could not reach them with the number provided by KU.

They advised me that the written notice from Amex was not valid notice under the terms of the contract; that I needed to FILL OUT THEIR FORM and send it to them with a check for $49; that only THEIR FORM REQUESTING CANCELLATION of contract would be acceptable. I protested, but in an effort to finalize any dealings with what now I had determined to be an unscrupulous organization, I immediately faxed them the filled-out form as they requested. I also faxed them a letter requesting verification from them that they had received the cancellation form. They never responded.

Having heard no response, in an effort to CYA I then FedEx'd ASF the original form that I had faxed, along with a letter stating that the form was enclosed as well as a check in the amount of $49. I requested that they respond immediately upon receipt of the check/letter/form. I also stated that any attempt to invoice me in the future and/or to damage my credit would be met with agressive legal action. I received no written, electronic or telephone verification of receipt of the FedEx pack.

Unbelievable as it may sound, this week, three weeks after they received the FedEx pack, I received another invoice with late charges added to it. When I advised them that they were paid in full and had received not one but two valid written cancellations ON THEIR FORM they advised me that they only received one cancellation, the one that I had faxed to them. That they had no record of ever receiving a FedEx package.

I then produced the name and signature from FedEx of B. Danielson, one of their employees who works in the mailroom, who signed for the FedEx packet. After keeping me on hold for 10 minutes a jerk named Brian returns to the phone and has the audacity to tell me that they had afer all received the FedEx pack but it contained only the cancellation form with no cover letter and no check. Now, of course, they want late fees, plus, plus. My response was: Pay for stop payment of first check and I will then issue a second one less any late fees, penalties, etc. They have refused this offer.

I work in the arena of serious international litigation (although I am not an attorney). At this point I am pursuing a class action suit agains ASF. I am looking for as many ripped off members of the public that I can find. Anyone out there INTERESTED IN JOINING A CLASS ACTION SUIT AGAINST THIS UNSCRUPULOUS ORGANIZATION PLEASE advise immediately. I am ready to commence ASAP. I have an amazing attorney who is willing to handle this case. Please respond immediately if you want in.

Again, a consumer complaint without the full name. It is impossible to respond to "Daz's" complaint without knowing his/her full name. I can tell you that Knuckle Up hires ASF International to process their payments and facilitate their cancellations as they would apply to the terms and conditions of their contract. I am sure ASF International was simply following the guidelines available. If "Daz" was given an incorrect number initially, I certainly apologize for that, however, that is beyond our control. We have one customer service number - 800-525-8967. That has been the only number we have had for the last 20 years. If given the opportunity (Daz's full name) I am sure I could look their file up and make sure the issue is resolved.
