Well, Bank of America gets away with so others can follow suit? Banks are allowed to change the order that checks are paid to maximize their own profit? I have lost several Thousand dollars in NSF fees because of this. The deposits are not posted for at least 24 hours. Fifth Third bought the bank we loved and it has been downhill ever since.

I know what you all will say "Stop writing checks without money in the bank".

Well just when I think it is safe to go back in the water, here they come again. Does it make sense that if you use the debit card and this money is deducted from your available balance immediately but then a check can come in and that one is paid first just because it is higher??? This should absolutley be illegal. The bank states that they do this to protect the consumer......I say B.S. Protection would be to pay as many as possible to reduce the injury to the consumer by several fees. So maybe the consumer would have only 1 fee vs. 5.? 30.00 vs. 150.00? hmmmmmm who are they really protecting?
Anyone interested in a class action?

So does it make it right to capitalize on misfortune or stupidity? Is this what we have become? I am not asking for a hand out but maybe a hand up. Fairness? Is it fair to charge 150.00 for less than 50.00 in transactions? Doen't this sound like loan sharking disguised as banking policies?

Have you considered the interest rate charged for such transactions? Shouldn't there be some protection for the consumer so that big business cannot continually punish those that have less? Big money follwos big money....so I guess we can blame our legislatrue.

The bank changed and so did its policies. I will be changing banks. The new literature they sent did not disclose this clearly. Of course, we are not asked to sign a new agreement.

Read the Bank's policies...

If you will read the bank's policies, it usually states how they work the incoming debits/checks. I don't bank at this bank, but I had a similar problem at my bank and went in and they explained it in addition to showing me the account documents that I signed when I opened my account.

You don't have a class action, they have policies in place and most likely you agreed to them when you signed the documents that opened your account.

You know, you know, don't write checks when you don't have money in the bank. You should take your own advice!!

I know it is hard, I live paycheck to paycheck and it stinks and I used to be able to hedge and now I can't. But frankly, you are breaking the law when you bounce checks, so make more of an effort not to do it. It will save you a lot of money!
