central payment corp They dihonored my contract. They overcharged. They pulled money from my account when not authorized. They said my signed contract was worthless and said the verbal one on the phone is the one I am held to. They owe me $540.48. This is what I have been able to discern. I have faxed them all info and all i got was an $87 and some change credit. Still owe the previous amount. They said I was not PCI compliant. Yet It proved to be I was,. They charged me for it. they als charged me for a FEE that was in my contract but doubled it. It goes on and on. San Rafael California

Susan,

     Here are the documents you requested as per our phone conversation.  Here is the contract I signed.  You will note and check your records. You will find in the sidebar, second page; the notation of

“3 month agreement” initialed by N.K. 11/15/11.

I had called and asked to terminate the contract for internet service.  I was that I had a 3 year contract.  I did not.

The immediate result was extra charges, additional fees and headaches.  The additional fees that accrued were two-fold.  Monthly fees for service I did not want, yet forced to pay.

Secondly, I accrued NSF fees for $76 for monies being taken from my account without notice.  This

Would never have happened if my account had been closed as I wished.  It would never have occurred if your billing schedule was correct.  By this, I mean that if you sent a bill before you collected monies;  one could plan and schedule to make sure all items are covered.  Yet I almost always received the bill the day after or two after your company has attached the money from my account, NEVER before the due date.  I did not receive many of them.  Specifically the one in regards to your changes to my contract.

Hence therein lies the problem of notification.  As you and your cohorts have stated, I was sent a letter informing me of CPI changing and their rules of PCI compliance.  It went from monthly to charging me up front for the year (how is it justified that I pay an annual fee when I don’t have an annual contract?).

I never received this letter.  PLUS  my contract I have is what is agreed to.  I did not sign anything nor did I receive an E-Mail or notification.  If it was that important to (to me) then you would have sent an E-Mail, AS ouy did when it was imperative we were PCI compliant.  Plus make sure that the mail was registered.  OUR company was PCI compliant.  You cannot change a contract without proper notification and the ability to cancel said contract.  We have been PCI compliant since 8/22/2012.

The following is a list of monies that I wish to be reimbursed.

$37 NSF

$37NSF

$103.00 for fees assessed by you to be PCI compliant and not able to cancel.

$104.95 for fees assessed before yaer contract was up.  ROAM PAY

$91.08 for four months of charges.  Last used 10/28/2012

$15.95 x3 for non PCI compliance.  Which I was, until the rules changed without notification.

$422.88 is expected as a reimbursement.  If there is any issues please mail all correspondence.  I would suggest registered mail!  Further action will be pursued in court.  We have stated aforementioned our reasons.  We are also using this written vehicle to cancel our “ROAM PAY” account.  The account expires May 4th, 2012.

This also serves as a written notice that we are cancelling immediately or INTERNET service.  We expect that no further charges will be assessed to this account.  Due to CPI’S lack of due diligence; we were allowed to be cancelled.

On another subject:  Any MIS-accreditation by PCI or negative reporting will be construed as libelous.

This documentation has already been forwarded to our Business Attorney, and demands may be amended upon further counsel.  You will be notified af any such changes.

I faxed all information I had at the time.  I waited for a response.  None was given.  (3/4/2013) So on 5/7/2013 I called and aske what was going on.  They said I was being recorded. When I said that I was going to take them to court; they immediately transferred me over to the cancellation department.  The lady said she had to look further into it.  She got back to me after many minutes and said that I had a verbal phone contract with them stating that I had agreed to a 3 year contract; which I was not able to get out of.  I said that was not my intention.  Why would I sign a 3 month contract then turn around and agree to a 3 year contract?

She then offerred to discount and rturn monies to me.  I was credited $87.88. Part of the credit was for overcharging me a fee.  This fee is part of my contract.  Funny how they now will pay attention to my contract!  So she credited that back.  Then she credited back 3x$15.95 for overcharge.  This ws due to their claim that I had not been PCI compliant, even though I was PCI compliant.  She realized their error  after further investigating.

They also charged me fo another month of service;  when I clearly gave them time to cancel the "ROAM PAY" contract as per the guidlines of that contrat.  There is another $37.95 that they overcharged.

There was another time that the service was not in use and they overcharged @2.23!!!!  I had the service dropped from my website!  Amazing how that happens.

So with all that I can make heads or tails of all of this mess with this company; the original amount of $428.88

plus one monf fee $18.00

$2.23 overcharge

$37.95 for one months billing that should have been cancelled.

$122.95 for a years advanced pay ( This was never fully explained. She said it was a fee that all credit card companies charge.  However not completely sure.)  Either way, I was being charged by each company per transaction.  WHy would I be charged again?  PLUS I did not use for a whole year. Nor was I charged that in the first year all at once.   That is $628.01-$87.53 credited to me equals $540.48 they owe me.

 We finally talked to a supervisor about the issues. His name is Nery Espinal.  He was gracious to listen to our situation.  After working together;  we came to a happy resolution.   All is better now.  PLease make sure to ask alot of questions about any contract.
