 I was rear ended by an Esurance customer. At first he was very cooperative and sorry. After the claim began with his company he was no longer reachable by phone. He suddenly forgot what happened in the accident. He had thrust me into a truck in front of me. The person driving the truck got out seen he had no damaged, jumped back in and took off. Since he was my only witness Esurance is refusing to repair my vehicle because I had a rust spot on my hood. They want to repair my rear of the car where the license plate holder is cracked. Thanks alot Esurance/All State. What a rip off. Obviously they were telling their customer not to answer his phone as I was never able to reach him after the accident. They also caoched him on "forgetting" what happened in the accident as there were no problems until the fact of no other witnesses came foward.

IN  the first place you need to find out if your state is a no-fault state If so, it is the responibility of your insurance carrier to fix the damage. They will then after fixing your hood , go after the insurance company of the man who rear-ended you. Thats why you carry insurance in the first place. And Iam also responding to the person who said that your bumper would be damaged.  With todays cars and trucks most of the the cars -truck accidents, the cars tend to go under the rear of the truck. This is caused by a few factor,  the low profile of most cars, the increased height of most pickups.  Iam a critical care paramedic and alot of rear-end collsion there will be no bumper damage only hood damage. You are also intitled to medical costs,as well as lost wages.

As to how the front end of the vehicle was damaged by being rear ended is pretty obvious. When you are in a long line of cars where two lanes become one and your are slammed into from behind you are going to launch into the vehicle in front of you. I just wanted my car repaired as I was an innocent victim. For the person to cooperate that day and then suddenly "FORGET" what happened or how many cars were there is what seems pretty "theroized" to me. You believe what you would like to. I am just stating what happened and how I was treated.

until the fact of no other witnesses came foward.

- Oh yea it of course was Esurance telling the person not to answer their phone or talk to you and coaching them what to say.  I mean it couldn't have anything to do with the fact that the driver was at fault and is worried about this claim making his insurance rates rise..no it couldn't be that.

Where in the heck do people come up with some of their theories..really this is a serious question.  Where in your warped mind did this theory even come up as a remote possibility?

Anyways..it looks like they are willing to take care of the rear but are refusing to repair your hood.  Well here is a question.  If the person you were rammed into had no damage..how did your hood substain damage?  Especially on the "hood" but apparently no damage to the front bumper, which on most cars is in front of the hood(at least the last time I checked).  So sorry but unfortunatly without a witness your story has a bit to be desired.

There is one more possibility.  As long as you haven't signed any paperwork waiving any future claims you can still go after the driver for the damage to the hood.  I would image it is a minimal amount that you can do in Small Claims without any lawyers.   Perhaps if you get him in court you can get him to admit that he really wanted to take care of this but Esurance told him to not talk to you and "forget" about what happened in the accident.
