I’ve been living here for a few months now with my wife and my Service Dog, because I can’t find any openings in my area. We’ve been here since june and it’s now September, and everything’s been great. No issues at all. But this week a new manager took over the location in Springdale Arkansas. This morning On my way to work I was informed that if I didn’t take my dog with me when I leave that I could no longer stay here.

So I provided them with all the necessary federal registration paperwork for my service dog, and also my paperwork/prescription from a licensed therapist authorizing the use of a service dog and explaining why I have a service dog. They laughed in my face and told me they could pay 15$ on the internet and get the same paperwork. But I stood firm, and explained to them that what they were doing was discriminating against me because of my disability, and that to kick me out because of my service dog is a direct violation of the A.D.A. (Americans with Disabilities act) and the F.H.A. (Fair housing act) and federally illegal.

So to take care of that they called the police and had them come out for a domestic disturbance and claimed that I was in the lobby yelling and using profanity. Which was completely made up. So when the cops showed up they claimed that even though I have all the necessary paperwork for my service animal, I still have to pack and leave because of the domestic disturbance that was entirely fabricated because the management knew they were in the wrong. and I’m now banned from the property for life. So I’m currently packing my stuff and Now I’m going to be homeless for the foreseeable future. All because I’m disabled.

Cite one case where it says it is a "Reasonable Accommodation" to be allowed to leave your "Service Animal" alone in a Hotel Room while you go to work.  Go ahead I'll wait.  Actually no I won't because you won't find one.  

Of course, if you still believe you have a case you can take my other piece of advice.  Find yourself an ADA attorney and sue them.  There are many attorneys who take cases like these with no up-front fees and only collect if you prevail.

 I don’t have any where else to go. That place was my home and I work in the food industry. I need a job so bad that I’m scared to bring the dog to work honestly, I work in a state where it’s literally legal to fire you for any reason they want. So I figured if I have to either battle with my job, or the place I stay, I’d rather battle with the place I stay because without a job I’d completely screwed.

In this situation I just have to live in my car for now, and I really honestly thought the law would be on my side. I’ve studied the ADA case law and I know my rights. What they did was illegal. They wanted me gone because of my dog, but when I supply proof of my dog being a service dog all of a sudden the story changes to ok well then you have to take it with you. There’s no way my job would go for that and even though yes, legally they have to allow me under ADA statute but so does this hotel under the very same statute.

I’m citing all my information for ADA website it’s self. I’m homeless now. What they did to me was wrong. My dog fits all the requirements of a service animal so to deny me service based on that is ADA’s website’s exact definition of discrimination. I’m staying cold hard facts. You’re arguments aren’t even valid arguments. Cite a supreme case that shows I’m wrong, cite a federal statute, go ahead, I’ll wait. You’re just arguing your own personal thoughts and feelings. We’re you there? Do you have a service animal? Do you own a hotel? Are you an expert in any of the related subjects? Do you own the place? The answer to all of that is no.

Can you, completely random guy, give us any real insight into this situation other than your own personal beliefs? The answer is no. If you wanna make petty arguments with people, take that crap to Twitter. That’s not what this forum is for or represents. I hope you’re comfortable with a roof over your head and a safe place to sleep at night while I struggle to find some where to park to sleep that I won’t get arrested. Thanks for all your concern fine citizen.

Still Wrong

First off "ada.org" is the American Dental Association, hardly a site I would go to for information on the Americans with Disabilities Act.

"Clearing an Unfamiliar Room"? So your Pet is an explosive detection Dog? Heck, I'd keep him with me every single day after all you never know when some disgruntled co-worker may stick something under your chair.

You were not kicked out because your dog was not allowed to be with you. You were kicked out because you wanted to leave your "Service Animal" in the room by itself while you went to work.  Had you taken your dog with you, you would still be there.

There are no statutes that say you MUST take it with you, but I can also guarantee you that there are no statutes that say you are allowed to leave your dog behind. The ADA only requires "Reasonable Accommodation". I doubt you will find any judge to agree that it would be "reasonable" for the hotel to allow you to leave your dog.

When they talk about "Service Animals" they are talking about ones that assist people like blind or other physical disabilities. Assisting with something a person can not do. Emotional Support animals CAN be considered Service Animal, but not all ESA's are Service Animals. But if you think you are right, then go ahead and file a lawsuit for an ADA violation. You could probably find a dozen attornies who would be jumping at the chance to take on what you probably think of as a "Slam Dunk" case for no upfront fees.

Also, it wasn't out of convenience. I left no rebuttal, and am still not going to leave a rebuttal, on the Police Report. Because I was not there, I have no idea what was really said or done. It also has nothing to do with the facts of the ADA.

False police report

 And you conveniently gave no rebuttal for them calling the police to file a fake police report just to make sure they had a way to get me out of there. And there’s camera in the lobby that can prove they made the whole thing up. Also cited from ADA.gov states, "that if someone the service animal meets the requirements to be excluded, if said person removes the animal then they’re still required to grant that person access with out the service animal.” But they banned me from the propert for life.

 The function of my service dog is to enter an unfamiliar room before I do, as I have PTSD from getting hit with an IED while serving in Iraq. My work is not an unfamiliar room. So there’s no to continuously bring him with me every single day. The ADA website it’s self states The ADA requirements state that "local governments, businesses, and non-profit organizations that serve the public generally must allow service animals to accompany people with disabilities in all areas of the facility where the public are allowed to go.”

This includes restaurants and foodservice lines, grocery stores, hospitals, school campuses, hotels, office buildings, retail stores, and other places open to the public.” Read directly from the ADA website. ADA also defines a service animal as any dog (and in some cases miniature horses) that performs a specific job. The job my dog preforms, as I stated above, is clearing an unfamiliar room. And again, I’m citing this information directly from ADA.org. Facts can’t be argued with. My dog fits the legal definition of a service dog, and there are no statues that say I must take it with me.

A pet is not a service animal

Your "Ripoff" fails when you made this statement.

This morning On my way to work I was informed that if I didn’t take my dog with me when I leave that I could no longer stay here.

People who need "Service Animals" do not leave them at home while they go to work. 

Would a blind person leave their dog while they go to work?  Would a person who needs to use a wheelchair leave that at home when they go to work? Of course not, because those people have a true need for their accommodation.

The manager was right, you can pick up various, very official-looking forms, off the internet for a few dollars. Some will even sell you "patches" and vests that say "Service Animal". But it doesn't make it one.

There is NO "Federal" registration of a Service Animal.  In fact, it is actually a violation of the ADA for someone to require some sort of registration.  You very likely got scammed by a site that charged you a fee to "register" your dog and has no connection to the Federal Government.  

One also has to ask why would you leave your dog while you go to work?  If it is a Service Animal, your place of employment must allow you to have it as well.   For the same reason as mentioned above, it is supposed to be providing you a service allowing you to function.  Your dog isn't doing you much good with you at work and it at home.
