Florida department of revenue approved an child support order that contained perjury . My ex wife stated she was going to make my life hell in the valley if a divorced her  57 days before signing the finanical affidavit .On the financial affidavit in the devastation she stated I haven’t helped them in four years since she has been at her mom. I provided receipts and text messages that she sent confirming my payment of the kids bills. The administrator over my case stated she could use the text because the text didn’t have an amount or were outside the retroactive dates. Both option was untrue and the text were submitted to confirm why I had the receipts in my possession.

After many delaying tactics such as but not limited to; leaving requests for motion to appeal in Department PO box (tracking number confirmed documents reached destination, but sat in mailbox for three additional days,) to miss deadline, sending time sensitive mailings 13 days after date on letter, although Tallahassee is two hours max away from city. When I asked Case admin, did she verify ex information she became hostile.

I was sick with lupus complications for the year which was the reason she signs the affidavit to follow through on her promise to make my life hell. I submitted my information to the Governor of Florida, and they forwarded my request to ask why would a department have “under penalties of perjury” in an attestation that they won’t enforce. The only response I received is that “we don’t have the tools to enforce criminal statutes”.

Which never answered my initial question: Why have a criminal statute in an attestation that you won’t enforce? If you as a department include a criminal statute in an attestation, should not there be a SOP or a resolution path to ensure that statute isn’t being violated other than when caught allow and assist the person with revision.

Even to the degree of changing case notes to state the text messages did not list an amount, although to messages clearly showed an amount. They department operates above the law to meet the incentives goals laid out the Social security title IV-D act section 458. That gives states department of revenue, reimbursements if they have a certain amount of people on child support.

 Everything listed I have examples, evidence and e-mail  from department employees  stating they do not have tools to enforce perjury .Although they have it on their financial affidavit within the attestation

If you are trying to show your ex is lying, what you posted here really doesn't help your claim.  You posted 3 images, each doesn't really help your case and may actually harm your claims.

The first image you highlight items in the claims she made under penalty of perjury. But you failed to highlight one part about the childrens medical bills being unpaid. Is that correct or false?

If another image you showed was a 3 text messages showing what you are claiming is proof that she accpeted the support, you are stretching it a bit. Yes you do mention an amount, the only reply is "ok".   That could actually be taken as she says okay to your message where you say the money is but not that you actually paid it.

Perhaps she called you right after that yelling at you that she never got it.

In the other image they stated they do not have the ability, but if you think a crime was coimiited toc contact law enforcement. So why have you not done that?

Perhaps you have receipts that show you are supporting them. But if those receipts don't add up to the amount you owe, you are on the hook for the difference.  There would then be a fine line between her claims of you not supporting them as it could be that you are not supporting them as much as you could.  The amount you owe is set pretty much as a formula based on several factors that are more proveable such as both your incomes and the epected costs required to raise the child(ren).
