Well I sincerely appreciate your site though I found it too late. I am asking now if anyone wants to sue or contact me to do so. I intend to take this to the fullest extent. Let me tell you my story.
First of all I went thru the same steps as many of you I made the call talked to a rep. Had a rep come to my home ect. The rep who came to my home kicked her shoes off had supper and then got down to business. She looked at our yard and helped us determine the proper site she said they would not have to dig more than 2 feet. My father is in the construction business, so let me clarify that looking at my yard I had to agree that they would be doing very little digging.

I have watched the leveling of yards for many years for the foundation of houses so I felt confident on my analysis for the leveling of a pool.
At any rate she told me about the pool advertised and intised and persuaded us on the midline 24' pool. Two reasons for my impulse buying were not being naive or gullable, but my husband is allergic to clorine which kept us from purchasing a pool for our children in the past. Second was the "lifetime guarantee".
They finally called to install my pool at the first of April. They set an appointment for friday april 23 at noon. I had promised a $900.00 down payment. I had already given my rep credit card info to pay $200.00 and was to give the installers a check for the remaining $700.00. Due to a death in the family I was not going to have the full amount by that friday I tried to contact my installers ,but never could so I called the company. I spoke with a male called Kendrick. He said I could post date a personal check for April 30 so that the installation of the pool could continue.

The installers finally returned my call late thursday night saying they would reschedule. I promptly called them back and left again another message letting them know what Kendrick had said. They called me the Friday around 10:00am saying they would be there in a couple of hours. They didn't show up until around 5pm
My husband had to miss that day of work because they said we both had to be present.

All they done was dropped off a blue crate loaded down with our pool and their bobcat. They then had me to sign papers stating that i specified where i wanted my pool.The next day they started installation. I had to run to town and when i returned I found a HUGE hole in my back yard.

My husband was upset and took me inside to talk to me about it. He said that she went from leveling to digging and tried to level where she had dug when she hit a big bolder. Then another, which ended up being 4-5 huge boulders by the time they were done.The installers were nice but charged me an additional $200.00 for their extra digging and time. By Monday they done the plumbing and collected their money.

I contacted Global Sun Pools on Tuesday as to ask questions pertaining to my warranties. The subject was disregarded and stated to me that they handle all of that and I really didn't have to mail any of the info in. Then I was asked how I like my pool. I told them I would have liked it better if I had access to it without mud. I finally told her the deal and described to her the mess.She ended up transferring my call to Kendrick who was once a nice person, now turned out to be very rude and non compliant.We finally agreed on me taking pictures with a digital and emailing them to him so a better judgement could be made on their part.

Thursday a rep called for the 3 day follow at which time I told her everything. She was very upset and said that it was the second complaint that morning.She also stated that she was going to make sure that this woman over kendrick would call me back and stated that she was the daughter of the owner. Friday I received a call but not from her. This was an older man who never stated his name but was extremely rude. Needless to say I feel I'm stuck with a big bill to get this mess cleaned up.

Before anyone says anything let me clarify I read my contract and I know I'm responsible for the clean up myself. However let me also state that the installation company made an error which resulted in them hitting the boulders in the first place. After reading other statements here I'm fearing the worse in that the I need to fear the quality of my pool as well. I'll keep you updated on my first disasters there as they appear. Until then I'm requesting anyone who wants to take action and stop this money landering company or who wants to know the details to help take action to contact me.

I have unlimited long distance on my phone as well so feel free to leave me a number and a good time to reach you if you would like to discuss it in full.

I also agree with almost everyone here in the fact of false t.v advertisement, enticing, ripoff, lies, corruption, and everything deviouse of this company. I want to see them brought down.

So I have filed a Chapter 13 bankruptcy in an atempt to pay some bills and to keep these vulchers from slapping a lien on my home! Well Global contacted my attorney's on 7-8-04 and then they called here twice in the same day while I was online and away from my computer.

Today July 14th the called under private caller and left a friendly message on my answering machine. He said his name was Kevin and that he was from the collections dept. He stated that they had placed a lien on my home because they felt that I was not going to pay them any money and that I should call them as soon as possible to resolve this matter.

Now that the dice doesn't roll in their direction they are getting desperate enough to be held in contempt for contacting me. So I boo booed and lost loretta's number. I have to try and find my tape recorder so I can call them back and let them know my chpt 13 case # and my lawyers name and number. I'm recording it so that they can't say I never notified them!

These people are so arrogant and stupid that they think us southern people won't be smart enough to fight them. Everyone needs to understand this... if you have gotten the pool installed already you need to seek legal advice immediately. Don't wait around for them to roll over and die they won't do that. They will slap a lien on your home.

They tried to threaten my lawyers and say that they had a lien on it.Well they have a lien alright ... they put a lien on the pool. Not my home and by law if they put a lien on my home now i'll own a free pool. Once you get them where it hurts..( their pockets) they won't stop threatening you, but they can hang their own throats. if you need further advice I suggest you [Place your comments below and be sure to include your FULL contact information so Rip-off Report can contact you.]if you have already had a pool installed! I have been in contact with Loretta I would say we have become good friends thru this ordeal. I also have spoken with Don Dare from the news station he is coming soon to film my pool. I have spoken with others and let them know as well as emailed photos to them to show them what a magnificent pool and mess they were willing to invest in as well. I have met with a lawyer and I am filing bankruptcy. My bankruptcy is keeping them from slapping a lien on my home. We have surendered our pool so now it's up to them if they decide to re negotiate being in the "repossession" buisness or not. Anyhow if anyone feels they need to talk to me or have suggestions I'm always up for some good, free, advice. Ya'll have a good day and God Bless!

Christena - I don't know if you've gotten this resolved or not - two suggestions. Lorretta (I think)in Tennessee is evidently working with a local television station - even if you are not in the same part of the state, they WILL be interested in your story.

The other thing is - on face of the contract, there should be a section that has a list of things with little boxes by it - things like "no stump to remove", "customer to remove stumps", etc. If it is NOT marked there that digging is required, I cannot see how you will be held responsible for this. Also - since they did destroy your property unnecessarily, they should be responsible for repair (especially if it is not noted on your contract that digging will be required). Keep in mind, that just as the sales people for this company are independent contractors, so are the installers. But, this does not release Global Sun from the liability.

update to disaster

I recently received a letter stating that they were going to do a EFT ( Electronic Funds Transfer) on my checking account starting on the 5th of June, and every month thereafter. Funny part is I never agreed to a EFT and I called the gentleman on the letter and stated that to him. He then told me that me and my husband did sign that and we even wrote down our checking account number and gave them a voided check. Now here is where everything fraudulant comes in and thus lets you know why they don't want you to consult with your sales rep anymore. Our sales rep Kit Tuck stated to us that she needed a voided check so that they could prove we had a checking account to make our payment with. As stupid as that sounds my husband and I agreed on it cause she made it make more sense to prove that. Anyhow I nor my husband wrote our account number on anything nor gave them permission to do so. I told the man I wanted a copy of that statement that we supposedly signed.... duely noted I'm waiting for that one to come in the mail, all the while I'm consulting a bankruptcy lawyer on the terms of them being able to put a lien on my home and I have contacted my bank on the fact of them trying to EFT my account.
