National Credit Corporation Fitness Usa NCC wants me to pay for a membership when the membership couldn't be used mishawaka, Indiana

I am writing this report because I feel that Ncc and Fitness usa are a joke all in its own!

I signed my brother in law up under my  fitness usa account. They gave him a temporary card to use untill he recieved his regular membership card. Two weeks went by and he never got the actual membership card. Ncc sent the appllication back and said it had flaws and needed redone because his temp card wouldn't work anymore. We re-done the paper work and fitness said that again my brother in laws membership card would be in his hands in two weeks. That never happened. Since the guys knew us at the gym they allowed us to come in and work out even though my brothers card didnt work. They told us after a while that they couldn't keep entering him into the system manually because it would red flag them and they could get into trouble for it. They wanted me to pay for him to get another card. Why would I pay for a card that was never lost or even had been mailed to us.

Eventually the guys that worked there quit their jobs and we showed up to work out and the new guys would not let my brother in law in because he didn't have his membership card. We tried explaining to them what was going on. They called Ncc to have another card sent and Ncc never sent it. Therefore they would not let him in to work out. I called Ncc  myself to find out what was going on. I told the lady that worked there that I wanted the electronic payments stopped. She kept telling me that I could not cancell the account. I kept telling her that I was not cancelling the account. I was told that you can call them and cancell the electronic billing from your checking account. We got into a big argument and finally I told her off. She called me white trash!!!! I then yelled at her to get her manager or who ever is in charge and she hung up on me. I tried calling back and calling back and they would not return my calls. I even tried telling her what my problem was before all this happened and that my brother in law couldn't get into the gym because he never got his actual membership card.

Finally about a year and a half later I get a court summons from a lawyer out of indianapolis. They said I had 30 days to submit a letter of why I was not paying for this account. I did so and also explained to her or them what the lady from ncc called me. "white trash!"... I called the court house because the lawyer for ncc would not return my calls. They told me that the case was open but no activity was going on. I been in contact with the court house several times throughout the year. Just the other day I got a letter of ACTION. Why would I pay for something that my brother in law can not use? Fitness usa nor ncc can get their sh*t straight and couldnt get him his card to get in out of three tries. Wouldn't you not want to fight this too? This is crap! Any suggestions out there please let me know! This is still on going right now.
