FDCPA Violations

AUTHOR: Steve - (U.S.A.)

Hello Tracey,

What you have described above is in violation of the Fair Debt Collection Practices Act as well as The Texas State Laws pertaining to debt collection. You should start by filing a complaint against Pentagroup with the Texas Secretary of States office in Austin, Texas. Pentagroup, as well as all debt collectors that operate in Texas, has a $10,000 cash bond on file with the Texas Sec of State ,Roger Williams, to cover any violations of The Texas Fair Debt Collection Practices Act in chapter 392 of the Texas Finance Code. From there I would contact Texas State Attorney General Gregg Abott. His office is in charge of prosecuting and filing suit in cases of consumer fraud. Both Atty General Abott and Sec of state Roger Williams have sites available on line. From there I would file complaints with both the Federal Trade Commission and the American Collectors Association. The FTC will fine them and the ACA creates peer pressure because the industry can not stand to have any more restrictions placed on it and make a profit. If it is legal in your state record all phone calls and keep a detailed logg of times, dates, names as well as any other information that can be used against Pentagroup.

Furthermore, Send them written notice via certified mail with return receipt to immediaitly cease all communication with you. From there I would file a complaint with the Texas State Bar Association against Pentagroup Vice President James Joseph "Jim" Thorpe. His state bar card number is 19989100. Jim lives at . Jim is a May of 1986 graduate of the South Texas College of Law in Houston, TX. You don't have to put up with this illegal activity any longer. Take the actions outlined above and your problems will be solved. I promise you. Best of luck to you Tracey.
