Tucker Man Sues SunTrust for 1.5M

Civil Case No:  2011-CV-209671

Dr. A. John Igein of Tucker, PhD, ABD, sues SunTrust for breach of contract, misrepresentation, fraud and conducting business in bad faith. Dr. Igein alleged that SunTrust manipulated its computer to debit accounts in ascending order in order to increase overdraft fees. To lay men, when you issue simultaneous checks two days in a role, SunTrust deposits the highest of the checks even though the check is issued later than the smallest amounts. The customer believes the smaller check will clear the account but only to find out that SunTrust credited the highest check, resulting in NSF return debits. The smaller amount is now deposited in a negative account, allowing SunTrust to charge the customers account to the maximum amount of verdraft fees, in this case, $36 charged six times, instead of one single fee for the larger amount.

SunTrust is also accused of charging balance check fees, and account fees that were never foretold or revealed to the plaintiff and patrons.

Fraud: Dr. Igein alleged that SunTrust charged several overdraft fees into a closed account that he paid $10 to close, and further alleged that when he reported fraud, SunTrust allowed the fraud to continue, allowing the former account to deep into negative balance, prompting SunTrust to charge several fees. SunTrust then results to constant phone calls and harassment.

In a landmark class action judgment, Bank of America paid $410 Million to its patrons with similar complaint.

SunTrust engaged in contract of adhesion where you are box into a One-sided contract, and basically SunTrust has the only power to determine the outcome of a complaint. If seeking court filings SunTrust contract of Adhesion specifies arbitration in New York.  Arbitration court is very expensive to claimants. Arbitration is a way to sweep a lawsuit under the carpet.

Dr. Igein, This is likeI know am committing a crime, but I reserve the right to how I should be punished. You and I do not have this type of choice if we do wrong. "The defendant actions resulted in serious harm to plaintiff three businesses." Suntrust is laughing at its bottom line is enriched in the billions from poor people who were being victimized.

The plaintiff however won in Superior Court to have the Arbitration take place in ATL.

The plaintiff complaint is set for hearing by August 14th 2012 at the Bay Arbitration and Mediation Center before Honorable Bruce Barrickman.

To support Dr. Igein and be a witness email (((email redacted))) with your name, address, and complaint.

Ken needs more education

AUTHOR: DrJohn - (United States of America)

POSTED: Wednesday, July 18, 2012

I believe you are one of those uneducated individuals just mad with the world. Do you need the banks to rip off people in order for you to have low interest bank accounts? Wow! Laughable and unintelligent insinuation!

You must be a Suntrust employee or stakeholder for you to be so angry. You want to talk about my education. I am one of those 1% who are better educated than everyone in the world. I just turned in my dissertation and that's what ABD meant. If you are so angry pick on someone else or come be a witness in court. Right now, you are not doing anyone any good.

You seems to have enough time to come back and see this post. You must be depress or something. get a life. Someone must get these big banks to pay or rather get their attention that they cannot continue ripping off David just because they are Goliath.

Mr. Ken or whatever your name is, many people like me are waking up and smelling the roses to challenge Goliaths like Suntrust in court. You don't like it...good grief.

I just found out your comment by use google. I see what you went though. It happened to me 2 days ago. It is hard to explain because I'm deaf and Im trying to make my best I can on my English.

On July 9th I did paid $50.36, went on to check statement, it was already took $50.36 out of my balance which is good because I used my debit card with pin number though it. Ok now I have remind balance was $26 on July 16. The $50.36 from July 9 was adjust and moved to date to July 16. It send overdraft fee 3 times because I took $20 cash out of ATM on July 16 even though I didnt know Suntrust was adjust amount and date. I went home and found this out I had 4 times overdraft fee. I thought it was a joke. I went on to check online statement and I notice there was $50.36 is the one cause my balance messed it up. I knew $50.36 from July 9 I paid was cleared and was took out of my balance. I do not know why Suntrust move $50.36 on July 9 to July 16, cause my balance messed up. Suntrust motivational was to get money from me on overdraft fee thats what I thought.

I end up -$207. Thank you Suntrust for adjust amount and date changed make my balance messy. It dont matter if you are good at it math or checkbook...the bank on computer is doing something adjust it any way they want to get money from you.

I dont have checkbook with me I dont order checks. I always use my debit card and use pin number I always check the balance by online daily. And  I never use as a credit. Because I learn my lesson from bank of america that was did to me overdraft out of control in 2008. So I opened sun trust and only use debit card with pin number...no checks, no use as credit on debit card. Oh man, still overdraft fee on me. I guess cash is only thing that banks can not fee on it because you are holding cash on your hands its your control not bank.

Is it your contention that the banks prey only on poor people or...

AUTHOR: Ken - (USA)

stupid, unable to balance a checkbook, poor people?

If you have so much money, why would they then single you out? How do they know who's poor?

Is "Poor" now a protected class?

Get a life and stop claiming phony credentials.  It's OBVIOUS you are lying.

Disgrace to all poor Americans

AUTHOR: DrJohn - (United States of America)

POSTED: Tuesday, July 17, 2012

Why are you so angry? I bet you did not go to school let alone understand the post or the case. if you close an account and your bank charges fees into an account that you paid $10 to close, and then begin to harrass you, don't you think you will be upset and want to know why? You are not informed and that is why the anger is coming from.

I bet I have money than you can ever envision in your life. Read or take up a book. May be you will have better discernment next time. This post is meant to help those people ripped off by banks to the tune of 140 billions annually and you want to make silly comments about my education. Get a life, pal.

I doubt you'll ever get out of your ABD status on your degree with your SORRY..

AUTHOR: Ken - (USA)

POSTED: Thursday, July 12, 2012

communication skills. Also looks like you degree doesn't help you balance your check book, hence the NSF fees.

These fees, you and others carelessly incur are beneficial to the rest of us, as YOU pay most of the banks account fees and allow the rest of us low cost or free checking.  For that, thank you.

You can't possibly be a budding PhD, ABD or otherwise.  You could NOT get your degree with your non-exsistent skills.

I don't know the merits of your case against Sun Trust, but your credibility is ZERO!
