I was the custodian to my daughter's checking account at TD bank. When my daughter turned 18, she took full ownership of the account. After over two years incident free, this December, TD bank started charging her ridiculous overdraft fees. Not only are these actions questionable, as I understand it, banks are required to offer an option to opt out of overdraft protection. When we spoke to the acting bank manager (Linda is all we know for sure, as far as her name) informed us that she was automatically enrolled in the overdraft protection program.

I was writing in defense of my daughter. The matter in question began when my daughter deposited a check and it took an inordinate amount of time to clear. Looking at the bank statement, it showed that the money was available, however she was charged overdraft fees. This forum doesn't allow me to present all of the facts of the case.

Overdraft fees

First of all someone in some back room at this bank didn't wake up one morning where they decided to pick on you and start charging you overdraft fees.  NO...you were charged overdraft fees because the account was overdrawn.

But there is the next issue.  Your title says YOU were charged overdraft fees, yet you then claim that when your daughter took over the account two years ago.  So if that was the case then SHE would have been charged the fees because SHE went over.  So perhaps SHE should be here writing the report.

As for "Opting-Out", you are actually almost correct in this.   You must "opt-in" to the Standard Overdraft Protection for Debit Cards.  If you do not opt-in, then if you attempt to use your debit card at a Point of Sale or ATM and there is not currently enough AVAILABLE in the account the card will be declined.  This does NOT cover checks or ACH transactions, with those there is no ability to "opt-out" and the bank(just like it always has had) has the option to either pay the check/ACH and charge you an Overdraft fee or return the Check/ACH and charge you a Non-Sufficent Fund fee.  Which by the way this NSF Fee is often just as much as the Overdraft fee.  

Not opting-in will also not cover you in cases where you have a pending transaction and when the final charge goes through it puts you over.  For example, if you go to a resturant they will only put through your bill(for example $50).  But if you then add a $10 tip, if when they finalize the bill later that night if the $10 puts you into overdraft.  Even though it is a Debit Card it will still incur an overdraft fee because they are required by regulation to pay it, since it was the pending transaction. 

As for opting-in.  It is VERY likey that you failed to read what you were signing when you opened the account and actually did opt-in to the Standard Overdraft Protection.

The good news is that your daughter got through 2 years without a fee, the bad new is that she was probably just lucky.  So hopefully this will be a wake-up call for BOTH of you about proper account management.  Oh and this applies to ANY bank, not just this one.

Why did YOUR DAUGHTER overdraft the account???  Did YOU teach her how to properly manage that account by keeping written records, an on-going running balance and then ONLY using the account if the on going running balance indicates she has enough money in the account???  Of course not!  You don't even know how to manage an account either...otherwise...YOU would not be blaming the bank for overdraft fees. 

Nobody never needs any kind of special opt-in or opt-out nonsense IF they properly manage the account as I stated above.  Its NOT the bank's fault or ANY bank's fault when the account holder doesn't keep their own written records with an on-going running balance.

 

Don't bother wasting the effort.  I'll tell you now I don't work for them.
