I used TD bank for almost 10 years and this last week they tried to charge me 280 dollars in overdraft fees for my account being mistakenly overdrawn by 16 dollars. I went into the branch at 26th and 7th avenue to correct the situation and I was left sitting by staff as customer service seemed to be taking extended breaks with no explanation and as I tried to get the branch manager to resolve the situation the goon rent a cop was giving me dirty looks. When after an hour the branch manager spoke with me she refused to reverse the overdraft fees. This is after being their customer for 10 years and never having overdrafts before. I was made to feel like a criminal.

Later the same night I talked to someone on the phone who was more reasonable and agreed to reverse all the charges and said that as long as my paycheck was deposited as anticipated I wouldn't have a problem. We're talking about a 16 DOLLAR overdraft here.

Then today they put on 70 dollars more in overdraft fees and refused to reverse them when I hadn't made any charges on the account in 6 days! This was after I was told there would be no more fees and the existing ones would be waived!!! I couldn't have put any more charges on the account to incur the overdrafts since I didn't put any additional charges on the account! This is complete thievery and I don't trust them with my money anymore. I'm withdrawing all my money before they fry to steal more and am never doing business with these thieves again. You should not trust them with your money and one one should do business with them. They should be investigated by consumer affairs, especially the branch at 26th and 7th.

You say there was only one overdraft and yet you got $280 in fees. Let me guess, you knew the account was low and decided to spend money on something you had to have and since it was the last transaction you made you believe there should only be one overdraft fee (if any). However, in reaity, when the bank posted the transactionsin the same order that they always use, you had 8 (EIGHT) items post to the negative with each of them getting a $35 fee. The other $70 in fees were probably for recurring payments or were non sufficien fund fees instead of overdraft fees.

The problem you face is that the same thing would have happened to you at any bank.

 Yep the typical, I don't have anything to go against what you said so I am going to just accuse you of being an employee.  Well sorry to burst your bubble, but I do not now or have I ever worked for this bank or any financial institution.  Where the only thing you have accomplished by trying to say that is showing your own igorance.

Because guess what the Class Action Lawsuits you seem to be clinging on to did NOT state that the overdraft fees were illegal, they did not say that the Posting order was illegal, what the courts had issues with was the disclosures.  Oh and I am sure you saw numbers into the millions of dollars that made your head spin...right?  Well if you actually break that down the only ones who make "millions" are the lawyers.  Each member of the class got about $70, no that is not $70 per overdraft, that is $70 total.  It didn't matter if they had a couple of overdrafts, or $5,000 in overdraft fees. 

As for the lawyers you are going to talk to.  Yea, how about giving us their name and location.  Or better yet how about posting the court information from the lawsuit they are going to file.

Anyways back to your "issue".  Since you posted no details of your account history it is impossible to tell you how the transactions posted.  So unfortunatly you are just going to have to wallow in your own ignorance, with this to think about.  Just imagine if you actually kept a written accurate register showing you exactly how much you had available to spend.  You wouldn't be in this position now...

The courts seemed to agree when TD was ...

...subject to a judgement in a class action lawsuit based on their unfair overdraft fees. There are hundreds on complaints online about these practices and I wasn't aware of the class action suit they lost until I was affected by their unethical practices.

Yeah right, I'm a thief for mistakenly making one overdraft in my entire life I mmediately tired to correct, not the ones who tried to steal 280 dollars from me. By the way, even under their own terms, proven in court to be unethical and illegal, there is NO WAY they could have charged me 280 dollars since my account was overdrawn by only one transaction, at 35 dollars per overdraft fee.

I see TD pays people to sit on here writing rebuttals instead of properly and respectfully dealing with long time customers who are made to sit in their branches for hours. Well you are stealing NO MORE money from me and everyone I know now is aware of your practices and many will no longer be doing business with you and I am speaking with the lawyers who have successfully represented the people you have harmed in the past.

 And I am sure you reconciled your bank account every month and kept a check register.  If you did these thing you would not overdraft your account and would not incur these fees.  Grow up and take responsibility for your money because you are the one to blame not the bank.

It is amazing how when you spent more money than you had in your account you had no problem "stealing" $16. 

Oh you say your's wasn't stealing because the bank allows you to do that.  You are right...but they allow you to do that per their terms.  Oh and what are their terms, that you are subject to Overdraft fees.

The fact is that you do not manage your account, do not keep an accurate register.  Or you are going to claim that you do..you are either intentionally spending the money or are just outright lying.

Oh but as an FYI, if you have any additional withdraws, checks, or debit card transactions coming in after you withdraw all of your money there is a possibility that your claims of "stealing" may be correct.  However, it would be you who would be accused of stealing and figuring out how to bail yourself out of jail.
