On or about May 5, 2013 I noticed my car started to hard shift, though I was driving as usual at about 45 mph. The problem happened off and on and is most noticeable when waiting at a stop sign, red light or drive thru at a restaurant. The shift jolt is most noticeable when needing to accelerate or shiftinh into drive--it does not happen when I go into reverse. The shift jolt sometimes is accompanied by a thud noise.

On May 7, 2013 I contacted Toyoya headquarters and discussed this with a customer service representative at 1-800-331-4331  She transfers me to a rude cantankerous, bitchy caucasian female who seemed to have heard the srory before. She states I need to go to a dealership and get a diagnostic which costs $132 in my area. She then stated that if any of the following codes appear P0750, P0753, P0755, P0758 OR P0760 that I would need to replace module first, if the problem persists then the faulty module could've messed up the transmission. She conceded that Toyota issued a bulletin (they knew about this sinve 2004) to the dealership, not the consumer, and apparently it is a widespread problem.

At some point I received a Toyota internal case number, she said there was nothing she could  do for me as I am not under warranty. I have not driven my car since May 25, 2013. I have 188,000+ miles on my car and apparently if it is not under 150,000 mile warranty they will not provide ANY form of equitable relief. I take very good care of my car and it is not my fault the problem did not appear within a randomly selected mileage they chose. TOYOTA ADMITTED they knew of the problem and they are liable for any manufacturer's defect  of the ecm/transmission.  

It is TOYOTA'S FAULTY/DEFECTIVE PART that is now causing my car problems. I now cannot drive it. It is a widespread problem and they're picking and choosing which cars they will repair for the exact same problem. Do not buy ANY Toyotas they have no quality, poor customer service and their reputation has steeply declined--with good reason. Toyota is a fraud. The National Highway and Safety Administration is working on a recall but in the meantime I can't use my car. Toyota is a scam, fraud, hypocrite and shouldn't be allow to do business in the U.S. In my book, you're not welcomed in my country. Japanese brand.

Toyota dealership clarification

The dealership I called was in Silver Spring, Md-- they are the ones who claimed to call CA and confirm Toyita CA-headquarters would pay. I never had my car serviced there but was referred to them by a fellow Toyota owner who claimed they work with you. I couldnt even get pass point A to make an appointment because they asked me how I paid for it and the amount paid (as if I stole my own car), instead of just asking for the VIN-- I will try another dealership.

As for as the the post about notice in 2004, NO CONSUMER was given notice in 2004, the fact was that Toyota knew about the problem since 2004 and withheld the information from the consumers and did not tell them about the widespread problem until years later. It cane to light because too many complaints were filed and nearly 250,000 toyota rav 4 owners were affected.

Clarifications

 There are a few clarifications needed to be made 1) Although Rav 4 was 2003, I bought it used in 2005. 2) Toyota did NOT give notice to cinsumers in 2004, according to federal records they did NOT tell consumers until nearly EIGHT (8) years later although they did inform dealerships earlier. So no, Toyota did NOT GIVE NOTICE in 2004. 3) The Toyota people in California mentioned that when I pay for repairs they would do a reimbursement. When I started to make the appointment with the dealership and they alled Toyota headquarters they denied and siad they will pay for nothing. I had two people tell me two different things.

  I think you are sorely mistaken.    Toyota is liable for manufacturing defects for the duration of the warranty.    Once the warranty is expired, it's up to the owner to foot the bill for repairs.    The fact that they are extending coverage to 150K miles for something that they are not required to fix is actually commendable.    Your post is a good advertisement for this company.

  Bottom line, your car has 188K miles on it.   At what point do you think you'll be responsible for fixing it when it breaks??

 Well did you take your car in for a service check? If you havent dont you think its a tad premature to CLAIM they are a rippoff? It could be normal wear and tear on your tranny. It is almost 200,000 miles on it. I can understand about the hard shifting but that problem can be caused by multiple issues. This just sounds like your looking for someone to blame. And by doing that youre looking for someone to pay. Lets put aside the fact that you have had your car for awhile. Lets instead focus on the numbers you have presented? So there was a Bulletin put out to the DEALERSHIPS but not to the consumers nor was there a factory or manufacture recall. You are attempting to place blame on a company that did thier duty and reported a POTENTIAL problem. Im 100% sure that the LAWYERS deemed that it wasnt enough of a issue to inform consumers since it was hitting a small amount of thier product. IN 2004!!! Its 2013. 9 years difference between a dealership notice and the problem happening to you. I would take your car down to your local toyota dealership and have the check done. If one of those codes comes up, then appraoch Toyota about reimbersing you for repairs. If they decline after showing them the proof because ANY smart person would take a picture of the code as it was displayed on the service monitor. And any smart person would get paperwork from the service center to back thier claims.

DO NOT TAKE IT TO JUST ANY TRANNY SHOP!!!! That the biggest mistake you can make. So many ppl lose out because they try and do it cheap and it costs them in the longrun.

TAKE IT TO A TOYOTA DEALERSHIP SHOP!!!! OR A CORPORATE APPROVED TOYOTA SHOP!! You can call the US headquarters for toyota and ask them who in your area is a approved and certified dealer. This way you have ammo. If it is indeed a manufacture defect and they know this, as evidenced by the fact that they gave you codes to watch for. If this is the case and it is a manufacture defect then Toyota has to try and make this right or face possible consiquences. Lawsuits tend to get the big boys attention, if only for a few mins. They WILL have better lawyers then you can get. They WILL have more money to throw at lawyers then you would see in 20 lifetimes. These big corporations have policies in effect that you can work within.

DO NOT THREATEN A LAWSUIT UNTIL ALL AVENUES ARE COMPLETED. They will shutdown on you. They will no longer deal with you in anyway once you threaten to sue.

BE NICE AND POLITE. RECORD ALL YOUR CONVERSATIONS WITH THEM. A unsolicited recording may not stand up in a court of law, but it will be used to show the hoops you were made to jump through. Inform them you are recording this for your personal use.

AND DO NOT BE A JACKASS TO THE PEOPLE YOU HAVE TO DEAL WITH!! Just because they have to work for a company, doesnt mean they are all personally accountable for YOUR problem. They are ppl just like you. Working to take care of thier families. You start acting the fool and giving them bullshit, they will close down on you and you will find yourself on hold until thier system disconnects you.

DO NOT GIVE A SOB STORY!!!! These ppl have to hear everyones BS SOB STORY. Point in fact, EVERYONE HAS A SOB STORY.

I hope this puts you on the path to getting your problem taken care of. Obviously this TOYOTA that you chose and have been driving for awhile has served you well with the exception of this issue. Give them a chance to try and make it right by working within the program instead of acting like a child and stomping your feet and holding your breath.
