VISA investigation very sloppy costing me much more than $1635

I don't know if US Bank is responsible for their VISA operation, but I was out $1685 due to VISA investigators making a very bad decision.  It revealed very poor training and supervision at their headquarters.  

When I was 1000 miles from home my car's automatic transmission broke down and I limped to a repair shop in Burien WA on First South.  I phoned first and got a good sounding reply from the shop owner.  In the shop I was told the transmission needed a new $400 torque converter, and the car needed a $700 tune up.  (The car ran perfectly on my trip).  I picked up the car 4 days later($1685 on VISA card), but the transmission shifting was very eratic and reverse would hardly move the car.  

I returned to the shop 3 times and various adjustments were made.  But still it was not shifting like it should. Finally I went back and a thick yellow fuild was added and I was told it takes a full day to work in.  I was told "the care is ready to go".  Much later I called VISA and cancelled the payment because I had given the man chance after chance to make it right.  I was very wary by this time so I took the car to Ford dealer and asked for a written diagnois, costing me $79.  It showed major faults and no reverse gear.  With no use of going back again I started for home.

I got 400 miles when the transmission died near Mt Shasta City.  There, a new shop replaced with a new transmission.  

But the new shop owner showed badly rusted bolts that had to be sawed off in order to work on the transmission. I asked him to put this in writing since it was obvious no torque converter had been inerted in the transmission.

I submitted a challege to VISA about my false repair explaining the cirucumstances and submitting 2 written statements supporting my cause.

VISA denied my claim.   I phoned the woman VISA investigaor to ask for a review of my claim in detail with an opportunity for my input.  This was denied.

I was told that the fraudulent Burien shop owner that "THE CUSTOMER HAD IN MIND FRM THE BEGINNING TO GET A FREE REPAIR" .  Further, he said they replaced the torque converter by removing the muffler.  

The new transmission was $3600, motel 5 days $450, Ford dealer $79.

VISA took the WORD of the shop owner against my TWO INDEPENDENT REPORTS.  VISA never consulted me in this process where I could have reminded the investigaor that I had returned 3 times to the shop with no real repair.  Forget the fact that no torque converter was inserted--just look at the fact that the transmission work was bad.  Very shoody workmanship on the part of VISA investigaor and on the part of Burien Transmission.  I was totally honest in my claim, never describing the sho oner as obese, dirty, with broken theeth.  Maybe I should have.

 You have a misconception of a "dispute".

VISA is not going to get in the middle of a He Said/She Said situation.  These dispute are more for if you claim you didn't even make the charge(fraud), or did and never received the service/item in question.  Disputing the level of service they gave is something they generally don't get into.   Yes sometimes they will agree but just because someone doesn't agree with you doesn't make it a RipOff.

Now, I am not saying you are right or they are right I am really telling you that your venue was probably the wrong one.  VISA is NOT a court of law they have no LEGAL jurisdiction as to if a charge is valid or not.  So in effect if they did approve your dispute the mechanic could then have filed a suit against you for the money, and the judge would care less if VISA approved your dispute or not. But this works both ways.  If VISA denied your dispute, you have the legal right to go after them in court if you can prove negligence.  For this amount of money it may be worth going after him if you have the evidence.  But if the courts don't agree with you..perhaps that is telling you something
