I enrolled in Wageworks for the March 2015 benefit period and ordered a monthly NJ Transit pass and a premium monthly MTA card.  I did not receive the MTA card.

I called on March 4, 2015 at 1:53pm and spoke with a representative before being escalated to Kylind, a manager at site 10.  She repeatedly advised me to purchase a new card and to submit my receipt for reimbursement.  The card is active from March 1st --not on its first day of use.  I told her that I would NOT purchase a card this late, because the only way for the card to be economically feasible is to use it from the first of the month.  She repeated the same advice several times.  I got the impression that she was taught to listen to key words and read from a cue card, and not actually resolve any issues.

She also suggested sending a replacement card, which would arrive in 5-10 business days, when the month was practically over.

It is my understanding that Wageworks has no resolution for issues such as this; a logical route would be to contact the MTA, have them cancel the card they have on record, and offer the option to send a replacement for a subsequent month, or a card for the amount paid, but without time restrictions.

I cancelled all future orders with Wageworks once Kylind advised me that neither Wageworks nor the MTA has any accountability for missing cards.  Apparently, Wageworks has the full autonomy to defraud taxpayers by making pretax wage deductions, but assumes no obligation to fulfill the terms of the agreed-upon consideration in return.

The $112 for which I was defrauded may not seem like much; however, I’m sure that collectively, the amount misappropriated is substantial.  I am looking for an attorney willing to initiate a class-action lawsuit.
