I am being harassed by California Auto Finance over a $250.00 car payment. Alan one of their employees has called me 9 times from a restricted line laughs, and hangs up, and I have the phone record. They are scaring my 17 year old daughter saying their going to reposes her car, and it's not even thirty days past due. What should I do. Here's a list of complaints from some of there other previous clients. Alan the so-called employee would not identify himself while harassing me. I want to take legal action against them for harassment. This finance company charges 36% interest, and needs to be put out of business. They are a detriment to the public

Seriously, are you just trolling now? "My payment is due on the 14th, and here it is the 18th and they are already 'harassing' me?" If I borrowed a hundred dollars from you and promised to pay it back on the 14th, and you called me on the 18th asking where your money is, would I be justified in accusing you of "harassment?"
You have an overblown sense of entitlement that you think that everyone else should recognize and cater to: "I'll pay you when I pay you, quit bothering me." No. You signed a contract. You agreed to pay on a certain date. When you fail to pay, you'll be asked why you aren't living up to your contract. That you consider this "harassment" is why your credit is in the toilet.
Nobody wants to deal with you because you don't believe in fulfilling your obligations. And the way you are going, someday you'll really miss that 36% interest rate, because next time it's going to be much higher.

My payment is due on the 14th of each month. What's the date today? The 18th, and they are already calling and harrasing me for the payment. These guys are pukes,thieves,conpeople, and complete as*holes. BEWARE. DON'T DO BUSINESS WITH CALIFORNIA AUTO FINANCE. They also charge 36% interest????? BBB where are you? Fair trade commission where are you. Help us little people please.

I'm sure the "insults" are EXACTLY like what we are posting here: Stop being a deadbeat. Follow the conditions of the contract YOU agreed to. Pay your bill on time, every time.
You find this "insulting." Which is why your credit is in the toilet and you are dealing with a subprime lender. Be prepared to be "insulted" with the facts your entire life unless you are willing to face those facts and get your act together.

You really need to be told what to do?

As the parent of a 17-year-old, you should not have to be told what to do. Because the answer is simple...MAKE THE PAYMENT.
With a 36% interest rate, they appear to be a sub-prime lender. The only reason you are with them is that you could not get financing from a regular lender. Any complaint about the interest rate is irrelevant as if you didn't like the rate the time to disagree was BEFORE you signed the contracts. Oh, and don't say you had good enough credit and could have gone to any other lender because if you could you would NOT have agreed to the 36% interest rate.
Repossession isn't a threat, it is a consequence of not making your payment. Not sure why you think that a car can't be repossessed until it is 30 days past due. Perhaps that sort of thinking is why you are with a Sub-Prime lender. A company can repossess the car at any time they fear that the borrower can not or will not be able to complete the contract. Yes, that often means if you are even one day late. Now many mainstream lenders give borrowers more leeway because it is a hassle to reposess the car.
But when you deal with Sub-Prime lenders they are often very strict because they are already dealing with people who have not proven they can handle credit. In fact, many of these lenders as part of the loan agreement will put in a GPS shut-off device in your car. This allows them to disable the car as soon as you are late, and makes it easy for them to locate the car if they want to repossess it.

If you are paying 36% interest, that means your credit is off the charts low. You should be glad anyone gave you a car loan to start with. They have every right to reposses the car if you are ONE DAY LATE with a payment and they will do just that. That is a FACT.

You owe this company $250, they keep calling asking for their money, you continue to ignore them, and instead fall back on "the interest rate (I agreed to when I signed the contract for the car) is too high and it's unfair to ask me to pay a bill I agreed to at the time."
"They are threatening to repossess her car, and it's not even thirty days overdue." So how many days does it "have" to be overdue to justify repossession, in your opinion? Sixty days? Ninety days? Is this what the contract says? Due dates are not Suggestions. They are not Optional. Unless the contract says otherwise, the company could have repossessed the car the day after the payment was due if it were not received (and it clearly wasn't.) Your daughter is 17 years old- which means, you "bought" her this car. YOU are the one who is delinquent on the payments, but you are hiding behind your daughter in your complaint. Your daughter is "scared" she's going to lose "her" car- because her father is a deadbeat.
Just curious- if I owed you money, and when you kept asking me to pay it complained that you were "harrassing" me, would you take me seriously in any way?
Just another whiny deadbeat. Here's how to get creditors to stop calling: pay your bills.
