We have been remodeling a home for the last 16 months and our contractor just walked off the job. They have been paid $401k. We only owe $17k more. Even though there is no draw schedule, we have paid them in full whenever they have given us an invoice.
On December 16, I was emailed an invoice for $12k. Our home is not even close to substantial completion. We have electrical/plumbing/HVAC to complete, drywall, flooring, tile in bathrooms, no shower glass, no toilets/sinks, no countertops throughout the home, missing doors including our 8 ft custom front door ($11k) and a triple stacking impact sliding door ($6k) trim/moulding, gutters/downspouts, etc. Not even a closet is complete. We do not have final inspections or a Certificate of Completion.
On December 23, they asked me for payment. I asked what their plan was if I paid them because it is very obvious there is more than $5k remaining work to be done. He again demanded a check. I said I would not pay them until they presented some kind of plan or assurances regarding the rest of the work (this is not even taking the punch list into consideration) so they walked off the job and took all unused materials and our front door with them! I filed a police report.
They have been in breach of contract several times throughout this process. They have installed finishes (cabinets) without our approval of their selection. They have made substitutions without our approval of their selection. They have completed work and submitted change orders after the fact that we have not approved.
They added $3400 to a $4990 bill for the well and pump repairs and said it was a "management fee".
They started submitting change orders for items that were originally under the scope of work claiming that they were now upgrades.
They started submitting grossly inflated change orders for work to be completed (i.e. $14k for a 22kw generator that is only $6200 full retail at Home Depot, $8600 for water filtration system)
Our only defense was to deny all change orders in writing with an explanation to document the breach of contract and to take on some of our own projects (i.e install of water filtration system $3000, install of propane tank)
We have never received waivers showing subs have been paid. They owe the well company $5k, the building material company $5k, the countertops were supposed to be installed today and the vendor only has a deposit, so they owe the balance of an entire house of countertops (kitchen/island/bathrooms/laundry room). They owe the electrician.
We have done nothing wrong. We paid these people a lot of money, in full, whenever they requested. They have blown through several timelines with no sense of urgency to complete our home. Now the gravy train is over and they are leaving and threatening to sue us.
All of this from a company with bible quotes on their website, facebook and invoices.
