We are trying to terminate what we believe is an unenforceable contract with a roofing contractor (High Performance Homes (HPH) ) but are being met with predatory business practices and harassment.

To be clear:

1. We attempted to cancel the contract after verbally and via writing (text) the HPH rep stated our roof could not be installed without an extra $7k on top of the original contract; we did not sign the subsequent contract they sent over afterwards.   2. HPH has performed no work on our property.

3. Nothing was purchased or delivered to our home by  HPH

4. We paid no deposit to HPH   5. We do NOT want them to do any further work.  

Here is the backround of the original issue.

On March 25, 2025, my wife and I entered into a roofing contract with High Performance Homes (HPH), which included flashing around four existing 2x6 skylights. After signing, we had no further communication for over a week, prompting us to consult a trusted independent contractor. On April 3, 2025, this contractor advised us that proper roof certification would be impossible and not up to Oregon Codes ORSC and the 2021 IRC Section R903.2 and R908.3 without removing and replacing two of the four skylights with new, up-to-code units, along with proper flashing and interior finishing. That same evening, I submitted a written cancellation of the contract via email to our HPH representative and to the company’s general inbox as outlined in the agreement.

Despite this, HPH continued engagement. A manager, Brian, visited our home on April 4, confirmed verbally and via text message that the roof could not be certified in its current state, and requested time to propose an alternative solution. On April 7, Brian proposed replacing two skylights for an added $7,000—raising the total cost to $45,000, not including interior finishing. I declined and was told a higher-level manager, Rocco, would finalize the termination. After further discussion, Rocco abruptly stated on April 11 that the contract was not cancellable. On April 21, HPH issued a $12,000 invoice as a cancellation fee, demanding a response within 10 days. Importantly, the original contract was materially flawed—it listed three skylights instead of four, mislabeled them as 2x4 instead of 2x6, and only specified flashing without addressing replacement, which HPH later admitted was necessary to certify the work.

Since we are continuing to receive threatening emails from HPH where they devoid themselves of responsibility. Additionally their attorney (who is based in CA) is attempting to get us to sign a "gag order," and if not they are threating Defamation of Character. We have only stated the facts as they occurred and even informed them of such when submitting online reviews.

I have filed a complaint with the Oregon Contractor Control Board(CCB) and sent them an official letter on 4/23 per the CCB process.   I contacted the Oregon Department Of Justice (DOJ) who referred me to the Oregon CCB.   I also filed a complaint with the BBB and there is an open case and they have not responded according to the BBB.

My wife and I are  55+, both disabled, and this behavior is unacceptable to us.

 Looks like the BBB with all their PHONEY BALONEY has you duped. The BBB is NOT part of ANY government or law enforcement entity. ARE YOU AWARE OF THAT??? The BBB with all their PHONEY BALONEY has absolutely ZERO POWER to force any business to do anything or enforce any business laws. The BBB calls themselves a "bureau" to DECEIVE the public into thinking they are something they are NOT. The ONLY purpose of the BBB with all their BS is to SELL their FAKE, useless "ratings" and FAKE "accreditations" to ANY business willing to pay the price. The BBB will now use your complaint as a SALES LEAD to badger this business into BUYING an A+ PHONEY RATING. The BBB with all their PHONEY BALONEY is nothing more than a PAY FOR PLAY con-game.
