Smart and Final Stole food Las Vegas Nevada

On July 20, 2020, I placed an online order at Smart and Final for approximately $150.00. The deliver person, who is a third party delivery service from Shipt delivery service, texted me that many items were not available. Then at check out time, texted me again stating the large beef brisket I ordered she could not process on her app.

After 1 hour of order reduction, I explained that the brisket was the core of my order, and to cancel. She stated she could not cancel. An argument ensued, I was abused on the phone, the delivery person stating she was not being paid enough for this, and that I was "harassing" her. I again told her to cancel the order and hung up. The remaining goods were not delivered, and my card was charged $88.70 for the remaining goods.

I called and also spoke to the manager directly at smart and final, who told me I had to contact Shipt to receive a refund. My card was not charged by Shipt, it was charged by "Smart and Final Enterprise". Shipt is also not available, the web site says fill out the form and it will take 10 days for them to respond. I received no food. I do not know if the driver kept the food, returned the food, or what was done with my food.
