This company and owner created a fixed fee contract for a list of deliverables. The deliverables included a completed Bill of Materials (BOM) and all of the engineering work, files etc..."everything needed for manufacturing". I paid the fixed fee in full and up front in good faith. My product requires safety certification like UL or ETL and it is impossible to obtain this without a BOM. We had a contract that supplies all of this so I felt safe. The owner secured my trust that he would source the parts for my first production and assemble them when I was ready and gave authorization to do so.

I paid the amount to do this and felt safe at that point. I requested the BOM and prototypes due under the fixed fee contract to complete UL first before buying production parts for obvious reasons. If you buy parts that don't meet UL standards you then have to buy new parts that do, it's putting the cart before the horse.

This business went ahead without my authorization and sourced parts for production. The company never provided a BOM therefore UL is impossible to get and the parts he sourced can never be used, not now not ever. I sued this company and won the lawsuit. To this day they never provided a BOM claiming that they didn't have the ability to do so. They sent my money somewhere and received boxes of parts with packing slips inside the box...those packing slips are the information that should be on the BOM so his claims are absolutely false and ridiculous. I have all of those parts now but he made sure I can never use them. He took everything out of their original boxes that he received them in and repackaged everything in UHaul/Staples boxes leaving no trace of BOM information. This was done maliciously and purposefully. 

After all of that I uncovered that he charged me 145%-294% markups on everything. He actually believes and said under oath that it's his "right" to make a profit off of the client without them knowing or agreeing to such outrageous markups.  This company preys on females with no experience, builds their trust and then leaves them with nothing. No product they can use or sell and he took my life savings. I sold my home to do this project. Now I have nothing.
