24 Fitness , Super Sport Gym. Fountain Valley , Calif. A.K.A. David Heart. The gym manager. Missrepresentation; Calif. Labor Code: 1050- 1053. One of the at will employees working in the membership department . Posted on my account that I was caught stealing. This was introduced by the front desk at will employee . The tall skinny male Hispanic adult. He did not provide the exact name. Of the at will employee that posted the comment under my name. Note: The posted negative comment reads: I was caught stealing . On , Tuesady , March 20, 2018, or March 21, 2018. I went to check in this gym at the front desk. The computer read : See the receptionist.  Then the tall , male Hispanic adult working the front desk indicated that some one from membership posted a negative comment under my name.  Then , I asked what exactly was the negative comment?  The answer was , as follows: That I was caught stealing. I then asked who wrote this? The response was a employee from: Membership. I asked for his name. None was provided. Under the , 6th Amendment no name was provided. Under the 6th Amendment every American has the right to know what they are accused of. To also include what the accuser is. To also include the factual supporting evidence to support the false alegation. If none is provided. This is hazing & harassment. Calif. Gov. Code: 12900. Also: Selective Enforcement. Note: No at will employee is required to say or do anything unsafe or ilegal . At any time. Calif. Labor Code: 6300.  When and before anything that is negative is posted on any gym member all the facts must be introduced. Because the burden of proof is on the accuser.  Just because of some opinion or what some one thinks is irrelavant. This can include status quo. Cops lie. F.B.I lie.  Thats why all the factual facts must be introduced. We must have all the facts to form a conclusion.

So to determine exactly what is a fact. We have: The California Code Of Evidence. Plus: The Federal Rules of Evidence.  There is two sides to a story then the truth. The excuse: I have witnesses. This is also irelavant. Why? What is the credability of the witness. So just because of they way some thing appears is irrelavant. Thats why when all the facts are introduced. Lots of so called witness testomony is not accepted.  Black's Law Dictionary.  So here is factual supporting evidence . Will the at will employee of ; 24 Hour Super Gym , volunteer for three forms of scientic evidence?  ( 1.) No. Lie. M. R.I.   This measures brain waves.  To determine honesty. ( 2.) California Evidence Code: 801.70. This is the lie truth serum test. This places the subject in a concious unconcious state of mind. Known as the comfort zone.  ( 3.) California Evidence Code: Section: 795. Hypnosis.  With these prequsites : ( 4.) Blood & urine test. ( 5. ) Plus: The subject: Must: must volunteer to be filmed . With verbal and written permission. To be filmed. To be posted on: You Tube. If we never see the at will employee accusing the gym member of stealing on : You Tube. This shows : ( Reasonable Doubt). This can equal : ( Guilt).  The onsite at will employee manager is : Aiding and abeting in this slander and misrepresentation of a gym member. This is called: ( Aiding and abeting. Calif. Penal Code: 31. This is also: Hazing & harassment. A violation of : California Government Code: 12900. No at will employee is required to say or do anything unsafe or ilegal at any time. California Labor Code: 6300.  All at will employees agreed on all pre-hire implied contracts to notcommit any acts prohibited against public policy.  At no time does it read in the pre-hire implied contract to be judge and jury. No where does it read in the 24 Hour Gym , to type hearsay or slanderous remarks on any gym member.  This also not in the employee hand book. So this is a breach of implied contract.  Calif. Civil Codes: 3300 and 3400.  This is grounds for termination.  For the manager : David Heart , to allow a slanderous remark to be posted on any gym member with out all the factual evidence ,is aiding and abeting. Calif. Penal Code: 31.  All Americans deserve : Due Process. Or Habeaus Corpus. Of the 14 Amendment.  This means: All the evidence was introduced.  To not have all the factual supporting evidence in accordane to the : Calif. Code Of Evidence and Federal Rules of Evidence is Hearsay.  Witness testomony.  What is the credability of a witness. 

To post a negative note on any gym member is a attack on a person's character.  This then becomes: Slander and defomation of character. The negative note. Must be removed. Plus: The name of the person who wrote this must be provided. Plus: The factual supporting evidence. That coincides with the : Calif. Code of Evidence . Plus: The Federal Rules Of Evidence . Its unknown known if this is selective enforcement ? Or or if this could be a racial act? Never the less , no paying gym member should have negative comments posted unless all the facts are introduced. Not based on what some one thinks . Or the opinion of some one.  The facts.  So if a person got caught stealing. What is the police report number? Where is the video footage ? The burden of proof is on the accuser.  This is bad customer service. Or is this a form of constructive discharge ? Calif. Gov. Code: 12900.  Note: For any at will employee to breach what they promised not to violate is a breach of implied contract. Calif. Civil Codes: 3300-3400.  This is what to inspect at this : 24 Hour Super Sport Gym.  After paying all the money for a year. $ 500.00 plus.  Bad customer service.
