Accountnow (Visa Issued By Metabank) Accountnow is violating The Electronic Funds Act (Regulation E) San Ramon California

On Sept 7, 2008, I noticed unauthorized charges (ACH) taken out of my account totaling $286.00. I immediately called Accountnow and filed a dispute/claim. I was told it would be 60 days before I would see any type of credit. I then followed up with a affidavit via fax documenting my dispute.

Two weeks later I learned that as a consumer I am protected under The Electronic Funds Act or Reg. E. and that if the finanical institute does not resolve my dispute within 10 days they must issue provisional credit while they resolve the dispute (45 days). When I called Albana in the disputes dept. she said they already received the funds back from whomever stole them from me, however they don't issue provisional credit so they will be holding onto the money until 60 days is up. I have called numerous times only to get the run around and I am floored that they think they are above a Federal Law that they can ignore Reg. E.

So, today I filed a complaint with the FDIC. Regulation E states that if they violate the law the consumer is entitled to treble damages of the dispute amount. I am seriously considering filing a claim in court.
