I had been having problems with Altegra Credit Company not applying my mortgage payments in a timely manner. I decided to send my future mortgage payments via Western Union Quick Collect after trying to get them to post my account
on time.

Despite sending in the payments via Western Union Quick Collect, I was still receiving form letters stating my account was in default.

I telephoned the Altegra Credit company numerous times and was never given a clear answer to any of my direct questions. The last time I telephoned this company I was threatened with foreclosure, the sale of my personal property and jail time if I didn't clear up the problem.

After that telephone call I decided to only deal with them in writing because I knew I was going to need proof that I was trying to take care of the problem and was not getting any cooperation.

A few months later after sending numerous letters to the mortgage company and not receiving a response, I decided to send them a RESPA Letter. Still I did not receive a response from Altegra Credit Company.

I was angry and frustrated that I kept getting these form letters stating my account was in default and decided to call the mortgage company one LAST time asking for information on the alleged default.

I was told Altegra Credit Company no longer handled my account and that my account was transferred/sold to America's Servicing Company in November of 2003 and that I should contact the new company.

I was given a telephone number and told to speak to someone there who would be able to help me clarify the problem. I called America's Servicing Company and talked to a female representative who denied receiving any paperwork
from me.

When I informed her I was not notified of the sale/transfer to America's Servicing Company and didn't know that I was supposed to send the payments to them, I was chastized for not sending the payments to the proper place and was told I was shirking my financial responsibilities.

I was given the name and address of where to send a letter and copies of the Western Union Quick Collect receipts explaining my reasons for not sending the payments to America's Servicing Company. I sent the information as instructed and never received a reply to my request for information on the alleged default.

I sent America's Servicing Company a RESPA Letter and did not receive a reply to the RESPA Letter.

I contacted America's Servicing Company on the telephone and asked for account information only to find their records from Altegra Credit Company were incomplete. I was told they would have to request a payment history from Altegra Credit Company.

I tried to be patient and finally decided to contact America's Servicing Company about the payment history. I spoke to yet another female representative who stated that I was sent a copy of the payment history and they were waiting for me to contact them.

I asked if they had received a copy of the Western Union receipts and my letter, and she said there was no record of the letter or receipts in her file.

I decided to telephone them again after hanging up from this individual within 10 mins after talking to her. This time I spoke to a male individual who stated they had received the letter and copies of the receipts and that a copy of
my payment history had not been sent from Altegra Credit Company to America's Servicing Company as requested according to the notes on my account.

Each time I telephoned America's Servicing Company I got the run-around.I spoke to several different people and can only say they leave a less than desired opinion of themselves upon contact.

Out of total frustration, I filed a complaint at the
Office of the Attorney General and the Federal Trade Commission againstboth Altegra Credit Company and America's Servicing Company.

I was assigned an investigator from the Office of the Attorney General. The investigator sent America's Servicing Company a letter and they actually responded. The only reason they responded was because the Office of the Attorney General contacted them on my behalf.

The response was they would get back to the investigator within a certain amount of time, and when that time period lapsed, they would send another letter stating they would respond within a certain time period. This went on for months.

When America's Servicing Company finally responded to the investigators letter they stated that I was in default of two (2) mortgage payments from over 5 years ago, but did not provide any specific information.

While waiting for the information on the specific time period it was alleged I was in default, I continued to send in my payments via Western Union Quick Collect. They accepted the payments and I didn't receive any default notices or any other correspondence from them other than their replies to the investigators letters.

Approximately, 3 months later America's Servicing Company finally responded by saying that my payments have been consistently late 2 months for the last 5 years, and that the payments received after that specific time period were
always applied to the payments in default.

When asked why I wasn't notified, they didn't provide a clear answer, they only repeated that the account was in default of two (2) payments and how the money was applied to my account after the default dates over the last 5 years.

I sent my next payment via Western Union Quick Collect. I didn't receive any correspondence from America's Servicing Company and we were still communicating via the Office of the Attorney General.

In October 2004, I was served with Foreclosure papers by the Sheriff's Office.

I immediately called Western Union Quick Collect to ascertain the dates the payments were acknowledged. I found the payments were acknowledged but the last payment I had sent was rejected due to Non-Sufficient Funds.

I immediately called America's Servicing Company and was told that the payment was rejected because it was not the full amount demanded in a September letter.

When I talked to their numerous represenatatives, I was told I received a letter stating I was in default, followed by a Demand letter and an Acceleration Letter When I said I hadn't received anything from them except the response letters to the Attorney General Investigators requests for information, I was told that I got the letters and she had proof I received the letters.

After trying unsuccessfully to state I had not received anything from them other than the responses to the Investigators inquiries, I resolved to fight these people to the very end no matter what happens.

I only had 20 days to respond to the Foreclosure papers and had problems finding a lawyer who was willing to defend against the foreclosure. I was advised to file a Bankruptcy to stop the foreclosure.

Bankruptcy is something I can not consider, especially since it is only 2 payments. Had I been given the information there were two (2) payments in default, those payments could have been made at anytime, including now.

Instead, I am now faced with not only the two payments in default, but I am now being forced to pay for the attorney's, service of the foreclosure papers, their added fees along with over 5 years of accumulated late fees.

I contacted the investigator from the Attorney General's Office and explained the entire situation and provided him with the proof he requested. I have not heard anything from the investigator for weeks.

I have contacted the Federal Trade Commission, The Office of the Attorney General, the Office of Thrift Supervision, as well as many other organizations about both of these companies.I have been informed there are others who have also filed complaints about America's Servicing Company.

During my last conversation with America's Servicing Company, they offered me a repayment plan that includes me paying over $5,00.00 in extra fees and costs.

Now they want me to sign a paper that says that I am agreeing to their terms of my own FREE WILL and VOLITION.

I need to find someone who will look these papers over before I sign them. Given my situation this is going to be virtually impossible to do because the lawyers I keep talking to advise me to file for bankruptcy.

I can not find other financing because of my credit history behind Altegra Credit Companies inaction, and since they never provided me with the information I requested, they sold/transferred my account to America's Servicing Company with the defaults listed, I am being forced into a repayment plan that includes extra fees that could have been avoided.

The stress of this situation is more than one can bare without some kind of assistance, the duress of being coerced into signing papers that say I am signing of my own FREE WILL and VOILITION are just too much to handle on my own.

I just received a reply from America's Servicing Company in the mail today that states they are looking into my situation and state that my foreclosure is suspended for 30 days. This is after I made the arrangements for a repaymnet plan on the telephone over 2 weeks ago.

This still does not negate the impending foreclosure unless I sign the repayment plan papers that say I am doing so of my own FREE WILL and VOLITION.

So.. PLEASE, if you have any complaints about America's Servicing Company, PLEASE file a complaint with the Federal Trade Commission, your local Office of the Attorney General and send a RESPA Letter to your mortgage company and send a copy of this letter to the Office of Thrift Supervision.

I know there are a lot more of you who are being victimized by America's Servicing Company, please don't suffer in silence like I did, file your complaints with the proper authorities and post your complaints hereat the Rip-Off Report.

The more complaints against America's Servicing Company, the more the authorities will be compelled to investigate their activities.

This Is Scary!!!

My Mortgage was sold to these people about 3 months ago. To date -- no problems. I will say though, their customer service is ROTTEN!!! They have no real website and for the first time since I have been dealing with mortgage companies, they have no way of paying mortgages online. When you call them, after you finally get through (pushing 1 for this and 3 for that, etc) on the phone, the person that you speak to is hardly American!!! IF you can understand what they are saying, they have a hard time ascertaining what your problems are.
Anyway, I will keep a closer eye on my account thanks to rip-off reports...

They are good at accepting payments and then say they never got them. I tried to refinance with several lenders (local and others) and none would do it. They all kept telling me that they would not deal with a company that uses unethical business practices.
They have a rep of buying mortgages then foreclosing and making a bundle in the process while you the hardworking homeowner get screwed.

I just saw your post. California law is that you have 90 days to get caught up on your payments. After a transfer, they cannot hold you in default for 60 days but since you are already late it probably will be reported to your credit. SO, pay immediatley. whatever you do, don't wait to make your payment, yes there can potentially be a problem so don't let any time go by. Hopefully you have been able to correct the problem since your post.

Newly transferred to ASC from Ameriquest

We were initially serviced by Ameriquest and had received a notice indicating that our loan will be transferred to ASC starting Feb 05. We had been late for our December payment and since we had auto-pay through Ameriquest, our January payment was withdrawn and applied for December and now we are late again for our Jan payment.

I'm getting nervous because when I called Ameriquest, they said that they couldn't do anything because the loan will be transferred to ASC and to call them on or after Feb 1st to inform them that our payment did not go through for January.

When I contacted ASC, the rep indicated that the loan was not in the system yet and to call back after 2/4/05. I am confused and very nervous about the loan payments showing up late on our credit report because we'll have 2 months of late payments through Ameriquest and given what I've read here, we could very well be the next potential foreclosure people. I'm scared because we just moved in in Sept of 2004.

How will this affect our future should we decide to refinance or get a new loan? Also, we have always set up direct withdrawal of our payments with most of our bills.

Now, I'm wondering if this is a good idea to do with Americas Servicing Co. Thank you so much for everyone's input and for sharing your personal experiences. This is my 1st time at this website and I find it very informative. Any advice will be greatly appreciated!

Most people don't know their accounts are being charged fees, late charges or mis-applied payments and/or escrow payments not processed accurately. In order to verify how our payments are processed, we need monthly statements from lender servicers just like we receive from our credit card companies.

It is not the total answer to mortgage servicing fraud, but it affords us the tool to be vigilent consumers that the FTC tells us we need to be. However, it is impossible to follow the progress of our accounts while blindly sending in our payments, trusting they are applied accurately, if we do not have a monthly statements providing us the tool to verify and SEE how our accounts are being handled.

I have sent ASC two RESPA letters and they have never responded to either! I complained back in September to the Pa. Office of Consumer Protection and once a month ASC writes them a letter saying that they are looking into my case but know nothing yet and Consumer Protection has done nothing but send me ASC response letters. They tried to foreclose and then stopped it themselves and yet they say they don't have my records from the other company.

Within 30 days they increased the amount I owe them by 40,000 yes 40,000 with no explanation. I was paying them extra money every month against the principal and now I suddenly don't have enough in escrow and have been charged for insurance even though I have repeatedly sent them my binder. They also have not told me where the extra money went to.

WIth the settlement they were only made to pay out a small portion of what they owe to their customers that they had abused and screwed out of their hard earned money. So even though they had to pay out they made a lot more than they paid by far and by reading their reports they are still up to their old tricks. I heard from out local news center that did a report on my situation that fairbanks and ameriquest were one in the same and that fairbanks is running businesses under many other names as well. My advise to all is to keep everything you get from them keep receipts cancelled checks to them , and tape record everything they say I do not care if it is legal or not they tape us we take them . Be on your gaurd and do not take any bull from any of these companies .

Still In The Midst Of Shady Dealings-AMERICA'S SERVICING COMPANY

Personally, I can't tell you how everything has panned out, because I'm still smack in the midst of it. I have filed with every regulatory agency, and everyone is working to resolve this problem.

In reference to the statement that these scam companies make millions/billions before being discovered; and a little penalty does not hurt them that much. I was one of those claimants that won in the class action suit against Fairbanks....No you don't get all of your money back when there is a class action suit. I only received 10% of what was stolen from me because of the amount of people who were included in the class action suit. There is a cap on what can be recovered. It seems that the government does not want to take these people out of business, but just reprimand them for their bad deeds. The government gets paid too from these criminals!

NEVER BEEN LATE BUT ASC STILL THREATENS TO FORECLOSE

I have never been late on a mortgage payment. However, when my mortgage was transferred to America's Service Company, suddenly 3 payments paid to the prior mortgage servicer was "lost." I sent copies of cancelled checks five times from February 2004 to August 2004 by Federal Express and certified mail. Each time, ASC claimed to have not received the packages, although each mailings required signatures. I have all the signature pieces. After contacting the OCC, America's Servicing Company then claimed they had to raise my monthly payment by almost $600.00 per month, because there was no money in my escrow account during the transfer. I then was able to produce a payment ledger from my previous mortgage servicer that showed that there was more than a sufficient amount of funds to cover my taxes and insurance. As of today's date, no one can tell me where the $4000 went that was in my escrow account. ASC tried to say that they paid taxes with the funds. However, my taxes were already paid by the prior mortgage servicer prior to the transfer of the loan, and we have been given proof of that.

Believe me scam companies exist, get caught, pay settlement fees, come back, and change their names. Remember what happened to Fairbanks Capital Corporation? They are now Select Portfolio, and they are doing the same thing that got them in trouble last year. The problem is, before they are caught, they have already made millions/billions on their scam. So a little penalty does not hurt them.

I posted here a couple of days ago, I am being cautious but I have a question for all of you that have been scarring the heck out of me. I have literally lost sleep and have not been able to eat, no joke.

Were you people in default prior to the transfer? or had you always paid your mortgage on time?
(that qustion is not meant to offend anyone I am
just trying to understand the whole picture here) I can imagine that could possible get messed up during the transfer.

I called my broker and asked about this company and she had heard of them and never heard of anything negative.

Also, I was able to call and speak to a representaive at ASC and and she gave me my new loan number, she was very nice and explained the process and basically told me not to worry. Yes, I got her name and her employee ID#. She also told me that Wells Fargo is their parent company.

I am going to set up a direct withdraw with them and have it taken out the 1st of every month.

There are laws against what people are explaining here. Companies cannot just take away your home. from what was explained to me mortgage companies will loose money by doing that. however, I was told by the rep that they are not a mortgage co, they are a servicing co for investors, so if anyone can explain the difference in the law, if any, I would appreciate it.

I have NEVER paid my mortgage late, that is first on my priority list of bills. Again, I am taking precaution during this transfer because of these posts. I already made sure everything is squared away with my present mortgage co. and made sure that there are no errors.

Also, I can imagine that a mortgage co. that transfers a loan to a "rip off" company with illegal business practices can be held liable, am I right?

I looked up some of my old lenders on this website and I saw complaints against them as well. Knowing that I have never had any problems myself makes me believe that it just depends on indivdual situations.

I just hope I'm right.........

I don't want to scare you but Wells Fargo Mortgage is a division of Wells Fargo Bank N.A. that does business as America's Servicing Company.

America's Servicing Company will deny any ties to Wells Fargo when you ask them. They will tell you all sorts of lies when it comes to their affiliation with Wells Fargo.

America's Servicing Company is the company that collects your mortgage or loan payments. You can read all the stories of people that are having problems with these companies here at the Rip-Off Report.

Please do a search here at the Rip-Off Report for Wells Fargo, there are numerous complaints people have about the way their mortgages are being serviced.

Compare the complaints about America's Servicing Company and Wells Fargo, you will see enough similarities to know that this is something to be extremely concerned about.

Wells Fargo may not own your loan, the company that you got your original loan from (loan originator) may still own the loan, but are only transferring the servicing rights (bill collecting) for them.

America's Servicing Company will be who you will deal with when it comes to payments and such. Your original mortgage company will tell you they can no longer help you after your account is transferred to America's Servicing Company. (Sad but true!)

PLEASE go to the below website ASAP and read everything you can on writing a RESPA Letter to your present mortgage company.

Even if you are not having problems yet, it is very adviseable to ask any questions you have about your mortgage using the RESPA Letter this way you will have the answers before your mortgage is transferred/sold to America's Servicing Company:

It has a sample copy of a RESPA Letter that you should send to your mortgage company. Ask your mortgage company the questions you need answered, and also request them to send you a master copy of your mortgage payment history from the date the mortgage began to present.

Always try to make the payment before 2:00 P.M. on any day but Friday. The reason being is that any payments after 2:00 P.M. will not be posted to your account with America's Servicing Company on that day.

NEVER make a payment on a FRIDAY because it can delay your payment being posted to your account for at least 3 days.

At the end of the year or if you loose your Western Union Receipts you can contact the Western Union Qwick Collect Office and request a research for your payments for a small fee.

I highly recommend you contact the Western Union Quick Collect Office at the end of the year and ask for a print out of all the payments you made for that given year.

I don't want to scare you but Wells Fargo Mortgage is a division of Wells Fargo Bank N.A. that does business as America's Servicing Company.

America's Servicing Company will deny any ties to Wells Fargo when you ask them. They will tell you all sorts of lies when it comes to their affiliation with Wells Fargo.

America's Servicing Company is the company that collects your mortgage or loan payments. You can read all the stories of people that are having problems with these companies here at the Rip-Off Report.

Please do a search here at the Rip-Off Report for Wells Fargo, there are numerous complaints people have about the way their mortgages are being serviced.

Compare the complaints about America's Servicing Company and Wells Fargo, you will see enough similarities to know that this is something to be extremely concerned about.

Wells Fargo may not own your loan, the company that you got your original loan from (loan originator) may still own the loan, but are only transferring the servicing rights (bill collecting) for them.

America's Servicing Company will be who you will deal with when it comes to payments and such. Your original mortgage company will tell you they can no longer help you after your account is transferred to America's Servicing Company. (Sad but true!)

AMERIQUEST transferred my loan as well

I just read Liza post and my loan is being transferred in FEB 2005 also. I found that there is a link between ASC adn well's fargo. I contacted wellfargo but no one could tell me exactly how there are affiliated. This is a concern to me as well. Is well's fargo considered the new lender but ASC is servicing the loan? Can someone explain more in detail. I looked up BBB and there is an unsatisfactory mark against this company(if it's the same). I found a website www.ascservicing.com they say they are a division of a well respected loan company, but they do not mention the name. I'm worried....

Please don't mis-understand what I am going to say here, I am not trying to be mean, sarcastic, or scare you in any way.

I just want you to be prepared. The same things that happened to those who have posted here at the Rip-off Report can happen to you. Please keep an eye on your payments and keep all your records in a safe place.

I am well aware of the payment methods accepted by them for a cost. BUT, because of they way they have handled my account, I need something more concrete as proof that payments were sent on time. That is why I choose to send my payments Western Union Quick Collect.

Western Union gives me a Money Transfer Control Number and I can check with them and get the date, time and acknowledgement number if and when I need it. This way I have proof from an independant source that my payments were made.

I would never give bank account information to anyone unless I feel it's necessary to do so. Your assets can be frozen and taken over at anytime they so choose. Giving access to your account information is inviting trouble.

Depending on what state you live in, it may be illegal to tape conversations. This is something you will have to be very careful about, the laws vary from state to state.

It's amazing you got through to ASC, had a response and they actually helped you.

I'm glad you have had good relations with these people and it's nice you feel secure in the way they handle your account.

The confidence you have in ASC is nice, but I ask that you please read the rest of the posts listed on Rip-Off Report about America's Servicing Company.

When you are finished reading the ASC reports, then search Wells Fargo and read the posts on the Rip-Off Report for the ones dealing with mortgages, foreclosures, etc.

After you finish your reading these posts, please keep this in mind each month you make a payment to ASC.

If strange things start happening to your account, and you can't get any cooperation from ASC, please come back here and add your own post listing the complaints you have.

It should be interesting reading.

FYI.. Wells Fargo is the parent company of ASC and I am sure you have heard of the class action suit filed by ACORN against Wells Fargo.. RIGHT??

No Problems With America's Servicing Company

Our mortgage was bought out by America's Servicing Company in August of 2004 after it was just transferred to another company which escapes me from our original lender Saxon. ASC was very good about the transfer and even when we had three hurricanes in Florida, they offered to give us a 90-day grace period with no late fees or threatening letters because of the impact the hurricanes in preperation and repair caused on our monthly income.

They offer a pay-by-phone service which is a little pricy at $12.50 per shot, but they also allow you to deduct from your checking account automatically. The only problem is that they will only go five days past your due date for withdrawal which is a problem for my wife and I because our paychecks fall on the 15th of the month.

Overall, I am very pleased with ASC's service and haven't encountered any of the problems the first person did have. I would just proceed with caution, but what I do is always tape my conversations with them and write down the employee name and employee number of everyone I speak with.

I have just recently been notified by my mortgage company Ameriquest that my loan has been sold to America's Servicing Company as of Februaury 2005. I decided to do some research on Goggle on ASC and it immediately put me here. I have read the posts about this company and I am VERY concerned about what I read but I would also like to ask these people what they might have done differently to assure that these things wouldn't happen again. I'm very sorry for all the problems you have had with this company but I would like to ask for your hindsight on what I might do to make sure these things don't happen to me.

Contact your representatives at The Office of Thrift Supervision---mine is Eddy Norfleet, and The Office of Financial Regulation, (Attorney General's Office), mine is Marcia Bailey. The Office of Financial Regulation along with the Office of Thrift Supervision has stopped America's Servicing Company forclosing on my home 2 times, and still they are up to their same old tricks.

I like you, received my September payment back because they claimed they never received my last 3 payments from my previous loan servicer. I sent them cancelled checks---and still nothing. They send a blanket note stating they are investigating--just to appease RESPA. However, nothing further is done. If you sign a document now, it supercedes the contract you have already established--and one in which A.S.C. has defaulted on. However, a new contract with them will cost you more money in the long run---and you will find out that they want you home, and not your money. They will find a way for it to appear that you have defaulted. Companies like these resort to intimidation tactics, because the general public will fall for it---they are afraid of losing their property, and in the end....they lose their property.

If a forclosure is pending contact the Office of Thrift Supervision to stop the foreclosure---again, and again if you have to. Filing for bankruptcy is unnecessary, and believe me, A.S.C. will come up with outrageous charges and fees, costing you another tens of thousands of dollars to be paid to them. You are not alone. Just ride this thing out---and in the end, we will all win!
