I received a call from ARA Inc. stated that I owe a debt on a vehicle back in 1996 that I can't recall that I owed and now they are talking about garnishing my wages if I don't pay the debt. They talking about they could take me to court for about $40,000 because of the taxes and additonal payments that was left on the vehicle that was repossesed they are willing to give me a discount on $28,000 which would have me to pay $2,800.

I explain to them that this is not on my credit report and they are trying to argue me down that it is. The statue of limitations has pasted because it's been 15 years. I contacted the court system and they don't have any record of me at all on it and I even double check my credit report and it's not there. How in the world can they threathen you about garnishing your wages. They also stated they have been trying to contact me which is a lie because if that's the case I would have resolved this along time ago. I had to put a stop payment on my account so that can't try to get any money out of my account.

The lady that called even had a story about the same thing happening to her that she is now paying off I was like that is crazy and I explain to her that I didn't believe her they would tell you anything to try and scare you. What am I to do with this people should I contact my job also to have them on point about this scam. Any suggestions?

Technically, a debt collector can come after you forever for defaulted debt...however, once the statute of limitations is up, which it has in your case..then they've lost the power to successfully take legal action and you don't have to pay the debt back. Per the Fair Debt Collection Practices Act, you can send them a "cease communications" letter and that will be all that you need to do. Per this law they must cease collection activity.

Send the collection agency a letter via Certified Mail + Return Receipt (NOT regular mail) stating:

Per the Fair Debt Collection Practices Act, cease all communications with me about this alleged debt. This letter has been mailed via Certified Mail with Return Receipt. Receipt of this letter is being officially time stamped.

If the debt collector calls you again, tell them that you have officially sent a certified letter to them to cease communications with you per the Fair Debt Collection Practices Act and hang up. Don't engage them in arguments. They have no legal power over you whatsoever so don't let them scare you with bogus threats. If they keep calling anyway, state the following to them:
Be advised that this call is being recorded. If you do not consent to being recorded, you need to terminate this call. Continuation of this phone call after officially being informed that it is being recorded implies consent to be recorded. This recording will be used to pursue Fair Debt Collection Practices Act violations in a court of law.

If they really take you to court, just show up and state that the debt is past SOL and is time barred.
