This company is the lowest of low, buying bogus debts and trying to collect on them. They are claiming I had a $250 student loan from 1998 (9 YEARS AGO), it shows they magically "Updated" it on 2006 which from what I understand resets the SOL, even tho I have never even SPOKEN to them much less agreed to pay anything ever. I never had the original student loan (What college lets you get a degree for $250!?!?) and will never pay this company. Now they have it listed TWICE on my credit report with a one-digit-different account, its the only thing messing up my credit at the moment and it's pissing me off. I wish there were someway to get it off my report and force these guys to drop it, especially since 1. it never happened and 2. its listed as 9 years ago anyway, well beyond the statues of limitations. If you ever see a letter or something on your credit report that says "Asset Acceptance Corp" be very weary, these guys are snakes.

Paul,

The fact that you know it is not your obligation makes this very easy to deal with.

First, send a written dispute to each affected credit bureau. Simply dispute the account for reason "NOT MY ACCOUNT", and demand copies of all communications used in the verification process as per your rights under the FCRA.

Second, send a DEBT VALIDATION letter to the collection agency and demand to see the original contract as well as a full account history and itemization of charges.

Stay off the phone. Do everything by certified mail, return reciept requested. be sure to put the certified# on the letter itself and keep a copy for your records. This is very important as it proves WHAT you sent.

The credit bureas must IMMEDIATELY remove the item while it is being investigated, and if it is not proven within 30 days, it must be removed permanently.

Now, file a lawsuit on the collection agency for your time and expenses in dealing with this, as well as the damage to your credit score. They know they cannot defend this in court and will in most cases settle out of court.
