Ordered flooring from beaverfloor.com October 29, 2002. Cancelled flooring June 16, 2003 due to non-delivery.

After receiving a sample box, and reading their literature, I purchased $11,000 of 3/4" engineered flooring on a year end inventory clearance sale. (April 2, I received an email from them for another inventory sale with shipping in 5 days). The original ship date was the end of December 2002. Beaverfloor policy is 50% at time of purchase, but they wanted and got the entire amount from me through electronic money transfer.

I paid to have the tile flooring in the house we're building floated to 3/4" so it would be level with the wood floor. Since the house will have radiant floor heat, egineered flooring is required. I cannot find any other 3/4" engineered flooring. No flooring has also caused major problems with my construction loan.

One piece of literature they sent me was a glossy color reprint from Good Housekeeping. This turned out to be not from Good Hosekeeping Magazine, but one of Neal's sleazy misleading business practices. Another misleading bit of information Neal has is his commitment Forest Stewardship Council. An email them them confirmed he is not a member.

Neal told me all refunds are being handled through NY Att. Gen.

You are owed a full refund ..According to New York Assistant Attorney General James Morrissey

AUTHOR: Roseann - (U.S.A.)

POSTED: Thursday, July 03, 2003

According to New York Assistant Attorney General James Morrissey, you should receive a 100% refund from Beaver, and not be included in the NY restitution fund. Mr. Morrissey told me that where a refund comes from is based on your cancellation date. Any cancellations after March 1, 2003 are entitled to 100% refund from Beaver. Pursue your refund through Beaver. Make sure you have an email that confirms your date of cancellation. If you don't get your refund within 30 days of cancellation, contact the Attorney Generals office.

Possible Solution to your problem

AUTHOR: Roseann Bayne - (U.S.A.)

POSTED: Monday, June 30, 2003

Barbara,

I feel your pain. I experienced the same problem as you. Our tile was also floated over radiant heat at 3/4" in anticipation of delivery of our engineered Beaver product. After we realized the wood would never be delivered, we put in a wonderful Harris-Tarkett longstrip product.

With the underlayment the new product came almost even to the tile. The underlayment does not limit the efficiency of the radiant heat. This product cost almost the same as the product we purchased from Beaver.

Unfortunately, if you get a refund through the N.Y. restitution it will only be 83 cents on the dollar. Fifty percent paid this year and 50% paid next year. You will only end up with $9130., ($4565. this year and $4665. next year). This makes it very difficult to go out and buy new flooring.

We had to spend money we really didn't have to finally get flooring in our house.

Good luck.
