I played Dark Orbit for about three months. I had almost $180 in the game account. During a game upgrade the system dropped me. I logged back on after the upgrade and my account was reset to beginner account. All my virtual property and advancement I purchased or acquired in the game with about 500 hours of playing was gone. Customer support couldn't explain it, said it was impossible and claimed they couldn't help me unless I could cut and paste them info from my account before it was lost/corrupted/whatever. The catch 22 is you cant give them info from an account when the complaint is about the account missing or having incorrect info because the info isn't available anymore.
I wasn't crazy or rude about it I just wanted a virtual property credit for my money paid in and time played. Computers do crash after all and so fair is fair. I even sent them bank invoices of the money they got from my account for the virtual property in the game. They didn't care and couldn't help me and wouldn't give me a credit.
I am in process of issuing a letter of demand as a precursor to my legal claim. Their terms of agreement are a joke. It basically says that you give them money and they promise nothing and no recourse for any reason, or no reason. Don't even get me started on their unenforceable "no class action clause". Well surprise ...they will get a lesson in what is a legal contract from the courts in San Francisco if they don't settle. I believe this is not an isolated incident Their responses were too quick and by the numbers to have not dealt with this problem or problems like this before.
I think a class action might be more appropriate but that determination cant be made until further information is brought forward in the discovery process. If this is the case I will convert to professional representation and let them handle it.
A reputable business provides a product or service for compensation and backs up their product or service. BigPoint is not reputable. Their BBB"F" rating proves that. So will I when I have my day in court.
