My husband signed up for an up-front cash payment, 18 month membership with Body Renew Fitness in Boise. The contract was finished on June 5, 2013. He gave no credit card.

I signed up month-to-month with the same gym, billing my credit card. Cancelled a few months later.

4-5 months before his contract ended he asked the front desk what he needed to do to cancel when the time came, they explained to fill out a paper and send it to the billing department (although in the same town, they make you do this.) Then approximately 45 days before his contract ended, he asked for the paperwork--they were OUT of paperwork. He went back again the next week, and AGAIN they are out of paperwork. He explained that we would be gone for some time, they told him "Don't worry about it!"

On May 17, 2013 he went back to Body Renew and requested the paperwork, they said the policies changed, now he needed to call a number and request paperwork? He calls, they tell him that because his cancellation wasn't 30 days in advance, they will charge him $369.00 on June 5, automatically re-signing an 18-month agreement. He explains, they were VERY rude. So he says "How are you going to charge me? You have no card!" They admitted that indeed, they DID NOT have a credit card. BUT they would take him to court. He invites them to take him to court. At this time we file a complaint with the BBB.

On June 5, 2013 a charge posts to my credit statement for $369.81. They illegally obtained MY credit card from MY cancelled membership and charged our card. I call to talk to someone, and they can't give me any info because the file is in SMALL CLAIMS COURT. How is it in Small Claims Court when they already got paid? They were going to call me back in 24 hours, no call. Since then 10 phone calls and 2 emails directly to the CFO have gone unanswered. Yesterday (April 7, 2014) they offered to reimberse me the $369.81 BUT will still take us to COURT for the money.

I have never dealt with a more dishonest and shady business in my life. Complete crooks.

They have over 40 complaints on the BBB website, with a RATING OF "F"
