This company did not contact me directly. They instead contacted my sister's in laws in Nebraska. I live in Wisconsin. They then contacted my sister, then my mother. They claimed that within the next 5 days a summons for a civil lawsuit would be at my door. They claimed that I owed nearly $5000 to Citibank from 2004. I had no credit cards in 2004, having had my identity stolen previously, I cancelled all my credit cards previous to that year. They also claimed that it must have been a valid debt because there was a payment from May of 2004. They told my mother the payment was a different amount and a different month. I was unemployed at the times they claim and made no such payment to anyone, valid or invalid debt.

I am trying to obtain a mortgage for my first home, so the threat of lawsuit terrified me. My mother paid them a "settlement" of more than $3200 on her credit card. It was an hour later than we learned they are not the lawfirm they claimed to be. They have no intent to actually sue me for anything and the debt is completely bogus.

If this company contacts you or anyone you know, please file a report with the North Tonawanda Detectives' Office. Detective Kuebler (pronounced Keebler) is persuing this to the fullest extent of his abilities. The Detectives' Office can be reached at (716) 692-4312.

Please do not feel ashamed if you were duped by these guys. They're pros at this. Only through speaking up and filing reports can these people be stopped.

Tri-Financial and all the other names they go by need to be shut down!!!

J. W. obviously does not understand how you were ripped off illegaly. Yes always make sure the debt you are being accussed of is legit. Make the collector verify the debt they are claiming you owe before any payment is made. Never pay a collector over the phone. Never give out any personal info no matter who they say they are and how nasty they maybe. I hope J.W. was dealing directly with Citi Bank and not with Tri-Financial when they cut a deal. If it was Tri-Financial I guaranty they will be calling you back in a few months or years for the rest. I sure hope you have the agreement in writing. Tri-Financial will not verify a debt because they can not provide proper proof to the debtor. You are lucky to receive any paperwork in the mail from them. They make their money off from threatening people over the phone. They like to use the scare method for their collections, which is totally illegal. They can not threaten you like they did with a Civil Suit and they can not talk to anyone else about collection a debt from you. They can only contact family, friends and neighbors when they do not know how to contact you, but they can not discuss anything else with them. That is ONLY if they do not have your contact info. Make sure you save all messages they leave and record your conversations where legal. In Wisc. you no problem in recording your calls. I had been dealing with Tri-Financial and they tried the same threatening phone calls. Saying I have a pending Civil Suit that will be filed at the Court House. Tri-Financial has never taken anyone to court. They also can not collect in the state of Wisconsin. I believe the only state they collect in is N.Y., but you would need to verify that. The A.G. in N.Y. has been investigating them and has recorded all my messages they left. If you have not filed with the A.G. in Wisconsin, do it, even though you are working with someone in N.Y. They will also investigate the matter and follow up with you. They need to be shut down. I would also contact an attorney if you have not done so already to make sure they pay for everyone of their illegal collection acts and get your mother's money back if payment could not be stopped. You can contact NACA for free or low cost attorney in your area(www.naca.net).
