I purchased a $15,000 2002 BMW from this Carnes Motor Company in South Houston. This car was to be an aniversarry gift for my wife. They told me the car was in exellent condition and that I only needed to get the oil changed. I purchased the vehicle in good faith and had my wife take it to get an oil changed the following week. The mechanic noticed the rotors had a deep groove in them and proceeded to inspect the vehicle. He found out that all the brakes were down to the metal and that they and the rotors needed to be replaced. He also said that the brake line sensor had been cut (not by accident) so that we wouldn't have know otherwise. I contacted the dealer who "kindly" reminded me that the vehicle we purchased "as-is". When I told him the estimate would cost me $800.00 and reminded him that I hadn't even had the car one week, he said he would have his mechanic work on it, at my expense, which would be cheaper than any another mechanic. I have been waiting for an estimate for weeks. Meanwhile, my brand new 2002 BMW (a nanniversary present to my wife) sits in our driveway.

Gotmark Must Have Never Been Ripped Off

First of all, what makes you think you have the audacity to judge another man's character? And what does my credit have to do with anything? The truth of the matter is I was buying what I could afford and I thought I was getting a good deal. So what if I went to purchase an anniversary present for my wife at a bad credit auto financing dealership - that's not even the point and you're lame for even trying to touch on that subject.

Secondly, what planet are you from where people with less than perfect credit should be taken advantage of. I'm really glad that you have an 800 credit score and a good job and can afford everything you want with no problem. I'm also glad that you have never, ever been ripped off by anybody. If that's the case, you are in a class all by yourself and maybe you shouldn't be on rippedoffreport.com in the first place.

Like I said, my sales person said that they had their mechanic check out the cars before they sale them. If the mechanic checked the car out as stated, the brakes should have been one of the first things he saw. Two other mechanics saw it as soon as I pulled up. The bad brakes were that obvious. And yes, they offered to have their mechanic fix it at my cost, but guess what Gotmark, the situation is still not fixed. After the brakes were supposed to be fixed, I drove the vehicle home that night and my Brake light, ABS light and DTS light came on. Then when I called the mechanic shop the next day, they said they could look at it for an extra fee. My only course of action was to cut all ties with Carnes (mechanic and all) and go to a local dealer. So the cost continues to rise which is costing me more each day. This is why I continue to complain so that other consumers will not be dupped into buying cars from Carnes.

So to you my friend, I say continue to live your perfect life with your perfect credit in your perfect little bubble where no one gets ripped off. Or better yet, just crawl back under the rock you crawled from under and let real people discuss solutions to real problems, what ever they may be.

As is" does not apply when purchasing from a dealer and there is evidence of fraud.

This is evidence of fraud. There are federal regulations regarding this as well as state statutes. Further, there is the implied warranty of merchantability from the UCC which in many states CANNOT be waived if the vehicle is purchased for the purpose of driving it on publice roads. You can verify this yourself by visiting www.ftc.gov and search for used car warranty.

Check with your State Attorney General's office for UCC applicability in your state.

Also, you should file a police report for the fraud (cut sensor line) and file a complaint with your State Attorney General's Office.

I would take the care to him and inform him that you will accept one of 2 options.

1. Return car and receive a full refund of the purchase price including any taxes, fees, etc.

2. He pays to have the breaks fixed.

I would give him about 10 business days to comply-then file complaints and consult with an attorney to sue him.

First of all it shows your genuine character by getting upset that you purchased your wife an anniversary present from a place that specialized in bad credit auto financing. ... You just told the whole world your credit sucks...

Secondly, you contacted the dealer and they told you "as is" ....
What do you expect for a 2002 $15,000 BMW from a pre owned car dealership specializing in helping people with less than perfect credit...

Last, the dealer offered to reconcile the situation and you basically are still bitching...

Find something better to complain about.. there are many others out there that have worse problems than your brakes and your wifes 2002 BMW that needs some new brakes.
