I've been reading so much information here about this company it is making me sick to my stomach. Why, because I've been living this same hell for over a year now. Not even late on one payment and this company put me in a position where I had to agree to extra payments per month to make up for a payment i had yet at that time need to send them.

During which time, i had to agree to send my mortgage payments to their attorneys. Attorney Ann Schwartz of Goldbeck law. I sent these payments to my attorney to send to their attorney named above who never applied any of my payments to my loan. Thus I am now going to lose my home in 2 months from today. I did all the contacting stating I wanted to correct this matter with no one , returning calls or giving me options on how to save my home from foreclosure.

Did all the appropriate Act 91 forms etc. with no help coming from anyone. As of today they want to make an agreement for me to take my back payments(which I have) along with their attorneys fees(which I feel I should not pay because they put me in this situation) and put this on the back of my mortgage amount, giving me a mortgage loan of what is almost 40,000 more then my current mortgage and way more then my home is now worth in this very weak economy.

After reading some of these horror stories, I am more afraid then ever to even make any type of agreement with this company at all. Seeing how they have screwed so many people out of their homes and money. Why isn't someone out there helping us? Why is the government or authorities doing anything to these companies that are taking peoples homes from them illegaly?

If someone has any answers, I would be happy to hear from you. On a good note, I believe I finally have found my hope and I would like to help others. If you write me I will be glad to give you the name and number of the person who is helping me to get my home back and my sanity. If you would like some hope just respond to this rebuttal.

These days, everytime I make a payment to anyone, I check later to see if it was posted correctly. Very easy to do nowadays. Keep track of that mortgage check you wrote, or paid online, etc. Make sure it clears your bank account. If it doesn't clear as timely as usual, call to find out why. If it does clear, check your account the next day to make sure the payment was properly credited. This can be done either online on with a phone call. Make sure your balance is what it should be. Easy to do. Go to the last statement and see how much went to principal and how much to interest. Make sure the balance shows your new payment. If there is a problem, it's easier to fix right away.

If you made a credit card payment that cleared your bank, make sure it was posted. If not, call immediately to find out why. Don't wait until you see it posted to your credit card account after the due date, then call to ask why it was debited from your bank days before.

Sometimes people say they made a payment, but it was never taken out of their bank account, so if the creditor chose not to take it out, that's too bad. Do not take this stance because it will backfire. If the payment has not come out of your bank, the payment will not be credited to the account that you paid.

If you make arrangements with your creditor, you need to ask them if the computer system has been updated with the arrangement. Make them do this while you are on the phone with them. Don't let them tell you they have put it in the notes. Do you know why? Because it is a computer system and the computer does not "read" the notes made. Those notes can be later deleted when they realize they erred.

Example: If they told you your car payment must be paid by the 20th or they are taking your car away, and you told them you can't pay it by the 20th, but you can by the 25th and they agree to the 25th, they need to update the date where the computer can "read" the update. If they just make a note, the car may be repoed on the 21st, or sent to the attorney on the 21st. They are repoed or sent to their attorney, en masse, by the computer system. They do not have individual people looking over each account to read the notes before it is sent away. If the computer has not been updated with your individual terms, the computer will spit your name out on the 21st rather than the 26th. Once your account is sent away to the other department, it is very hard to change it back.
