I recently moved states and did not have a job to go to. I finally found one, but it is commission, so the first few months were lean. I missed one payment with Citi, and am still about 30 days late.

I receive anywhere from 5-10 phone calls every day from CitiFinancial. These calls are also happening to me on Sunday. This past Sunday, I received 5 calls. All of these calls are automated dialing and the voice is automated also with just a phone number.

These calls are getting to be very stressfull and abusively harassing. The calls and the voicemails are filling up my voice box in two days. I have heard that the Telephone Consumer Protection Act says that it is illegal to call a cell phone with an auto dialer and then leaving voice mail with an automated voice. Is this true?

Also, isn't there a law against the abusive phone calls too? I read where CitiFinancial used an alias in calling this one couple, which is against the law and they were fined 500 for each call (3), which they tripled, then the courts tripled it. Then they were fined 500 for each call (3) where they represented themselves wrongly, which was tripled, then the courts tripled. It cost Citi 27,000 for 3 phone calls!!

If there is anyone out there who can help me with this, please do so. If there is a class action involved, put me on the list. I have a new baby due within a few days, and these phone calls are putting me on edge, stressed out, and just afraid to answer my phone. This is not healthy and I do truly believe that what they are doing is highly illegal, unethical and downright unlawful.

Any help would be apprecited.

Sorry, John is right, I had the wrong rule. The Fair Debt Collection Practices Act is the correct law here, sorry.

TCPA misconception

The TCPA is only applied to telemarketers to which one has never had a previous business/contact relation. Citi-being the creditor with the individual and trying to collect on their loan, has the right to call and is immune from the TCPA.

The TCPA can be enforced in at least three different ways:
The individual who receives a call after a name removal request has been given to the caller is granted a private right of action in a local court and may sue for $500 in damages for each violation. In some cases, the courts can levy triple damages. Similar suits may be filed for violations of the TCPA's provisions regarding faxes, autodialers, and artificial or prerecorded messages. States may initiate civil action against offending companies on behalf of their citizens. Complaints may be filed with the Federal Communications Commission, which has the power to assess penalties against parties in violation of the TCPA.
