We were financing a 2000 mountaineer from credit connections in harrisburg, we had the car about 13 months on a 2 year lease. We were on time with the payments up until the beginning of october. They repossesed the car on tuesday, october 13th, but we were also told that we would have the opportunity to pay the outstanding balance which we were prepared to do that friday.

 Come friday morning, when I was finally able to speak to them after calling since weds. morning we were told that we wouldnt be getting the car back unless we paid the full loan balance, why you ask? There is a clause in the contract that states, 'tampering with the GPS locater is cause for immediate termination of contract'.

Now back in july, I replaced the starter but the car still wouldnt start so I took the car to my mechanic and he got it running again. At this point he told me that the reason was a group of wires that were protruding from under the dashboard one of which was the ignition wire, another one was the wire for the GPS.

I noticed the group of wires hanging from under the dash on the driver's side soon after we got the car but never bothered with them mainly because I didnt know what they were but I could clearly see that they had previously been cut and taped.

So basically between the down payment, by-weekly payments, and repairs were out about $3,000 and no one will even speak to us.

My wife and I are not thieves, nor are we dishonest people, but because people have disabled the GPS locators on their vehicles and stolen them we are automatically put in that catagory

Very Interesting Case!

My first question here is why are you messing around with a CAR FLEASE for a used car???  But beyond that, or should I say, setting that matter aside, I think you have an interesting case here.  What this all comes down to is the definition of the word "tampering".  Does the contract define what in their view "tampering" is?  In court, if there is no specific language as to what is defined as "tampering", then the concept of "what would a reasonable person" define "tampering" means.  I believe that reasonable person would define tampering as an attempt to remove or damage this device for the purposes of defrauding the lender.  That same reasonable person would also describe removal of this device or temporary disconnection for the express purpose of electrical/starting system troubleshooting or repair is NOT tampering.  Did you explain to them and provide written proof a mechanic worked on the electrical system and therefore this device may have been temporarily disconnected?  After the mechanic worked on the car, was the device functioning properly?  If there was absolutely no attempt by the mechanic to disconnect this device for the purpose of avoiding collections functions, then I would contact an attorney in your area and discuss this with him/her.  If they have placed a notation on your credit record which is untrue in this regard, then you may have a cause of action against them.

 At this point, the biggest enemy is YOU...if you just sit back and do nothing!  DO NOT take the position you are at their mercy!  Please, do not be an impossibility thinker...run this by an attorney!!!  You might be able to get an initial consultation for free!  You won't know what kind of case you have, if any, unless and until you take the next step!  Please, don't delay and write back!
