Delivery Waiters Confirms your order but never delivers? They should be called "Waiters that don't deliver"! Winston-Salem North Carolina

I received a "order confirmation" from an order I placed two weeks ago with this restaurant delivery service, and they never delivered the food! 

I ordered a meal for my brother and his wife (who is very ill and recently home from the hospital). I thought this would be nice to send them a dinner (I live out of town). I ordered the meal, gave my credit card info, and received and email with an "Delivery Waiters Order Confirmation - Order #3164" confirming my order. I was shocked to hear from my brother that food never came!

I  called and left a voicemail (no one answers the phone at this business) and when he called me back he was argumentative and said he had to confirm it over the phone to place the order. I had a typo in the phone number I  put on the order, he stated he had tried to call me. However he admitted he made no effort to email me when the entire transaction had been via online/email!!!! 

Once I receive an "order confirmation" that, by definition, means the order is confirmed, right?!?

The man offered to place the order, but at full cost. I asked, as a customer service courtesy, that he make it up by placing the order for free. He, in an argumentative tone, said he wouldn't do it for free and he would only do it if he could charge me. I said I intended to file a complaint and he replied: "Go ahead and contact the Better Business Bureau, no one looks at that anyway."

I am am disappointed that such poor customer service can survive in this market.
