Design Homes Code violation ruined our home and makes us sick in more ways than one Prairie du Chien Wisconsin

November 8, 2010 we had a house fire that completely destroyed our home.  Displacing a family of 6 we found temporary residence.  We had decided to purchase a modular home so we could get our family back home as quick as possible.  The home we purchased was discounted as it was a display home, even better then we didn't have to wait for a home to be built.  We were aware the home was "as is", which addressed things as the linoleum that had tears, some dings in the doors, etc.  Not a major construction issue. 

Over the past year plus there have been several unexplained illnesses in our home, especially with my youngest.  We had discovered a major black mold infestation in our living room.  Continuing to pursue the source, took apart sheetrock on the living rooms walls only to find black mold from inside all the way to outside.  Yet, trying to find the cause, our contractor looked around the chimney only to discover that the house was not build to code.  There was flashing missing completely on one side of the chimney, on another side the flashing didn't even come to the corner and the house wrap was not over top of the flashing as it should be BUT underneath, still leaving access for water entry.  This falls into MAJOR construction issues and would not fall into the "as is" statement as given by Design Homes.  Major construction defects must fall within a 10 year time frame - as this does clearly.  We have already made calls to PFS (their inspection company), HUD and the state inspector - my family is living in a massive mold infestation and Design Homes has no concern for the already occurring health issues.  We have not even looked into the basement bedroom yet for possible issues there from water run off.  My family has been through so much and now we have to fight for what is right. 

So there resolution is they will make a "fair contribution" to repair.  State contractor code says if there are issues within a 10 year time frame - its their responsibility.  So instead of taking responsibility for what has happened, they chose to blame the inspectors.  But if their builders were knowledgeable they would have never completed the job the way it is.
