Randy York filed a PETITION TO SUSPEND OR TERMINATE CHILD SUPPORT and told his client to reduce his child support without an order. A year later, after becoming District Attorney General and using delays to eat up my retainer York served me with a court date. Prior to the hearing DAG York met with me alone and intimidated me, an unrepresented citizen, and requested that I sign an agreement to retroactively reduce the financial support for my 4 children. I refused. DAG York represented his past private criminal client who was 12 months and $34,800 in arrears (a federal crime). I was unrepresented. York's client did not meet the criteria required by law for a reduction. Arrests are not considered a basis for reduction and his client still received the same monthly income his support was based on. His client was in arrears and that alone negates qualification for reduction. His client was over $11,000.00 in court ordered medical arrears. His client should have been put in jail like all of the other child support evaders York prosecutes. Instead, York took advantage of an unrepresented citizen and committed fraud upon the court. He reduced the support for a criminal who did not meet the criteria for a reduction, he entered a health insurance premium into the calculator that covered 6 people at the monthly cost of $1800.00 instead of pro rating it as required by law, and he did not enter into the calculator the uninsured medical expenses I pay or the special expenses discussed at the hearing. York illegally reduced the support retroactively in order to erase the arrears he encouraged his client to accumulate. York entered an order to REDUCE CHILD SUPPORT when only a PETITION TO SUSPEND OR TERMINATE CHILD SUPPORT was prayed for. It has taken 12 months and $12,000.00 in attorney fees to reinstate the child support. My children have suffered for over 2 years while their father, a physician, has enjoyed an income of almost $10,000.00 per month. DAG York has violated my civil rights and the rights of my children. He is a public official, he is sworn to protect the innocent public who depend on him. Not his past criminal clients. There is also the fact that a child support case is to be decided in 45 days for a NON TITLE IV-D and and 35 for a TITLE IV-D case. Not two years!
