I joined Fit Zone three months ago and agreed to a two year contract because it was economical and within a couple of miles from my home. I specifically asked them two questions when I considered joining: 1) Are you going to be closing any time soon and 2) If I move, would I be able to transfer my membership. The answer to both questions was a resounding "NO."

I received a letter on 25 July 2009 from them stating that they were closing the location where I was a member at but had "negotiated" for me to go to a gym across town or in a completely different town which mileage wise is about the same. This was unacceptable. I don't drive except when there is no other choice. I walk or bike every where. I work outside my home 7 day per week and go to school on-line.

I sent an email to Rachel, who was listed in letter if I needed a point of contact, explaining to her my dissatisfaction with this arrangement. I received a call today. The just of the conversation was "too bad, you have a contract and we are holding you to it." Her attitude was cold and disinterested.

I consulted with an attorney and he said they could legally hold me to this contract. I agree I signed a contract but they changed the terms of the contract making it almost impossible for me to go to their gym. I am forced to pay $25 a month for a gym that due to their actions I cannot use without paying extra for gas and maintenance on my car plus finding the extra time in my already packed schedule to go across town or to the other town to work out. If I bike there, I don't need the gym.

I may be legally responsible for this contract and I am not contesting that, but what happened to being morally responsible? Had they let me out of the contract I would not be writing this. This comes down to legal extortion.
