I was in a MAJOR head on collision with my 2007 Dodge Carivan SE yeaterday. I had my 2 sons with me! I bought this vehicle because I was told it was extremely safe and roomey for my family. I braked too late yes accident was my fault. Kids were arguing and Im 38 never had an accident or a moving violation in my life! But yesterday I hit a Ford explorer. My entire front end of my car is like an accordian! smashed up to windshield. My son hit his head and has eye trauma.
I am sick and am on bloodthinners, so I am soar and brused thank god no internal bleeding! I can barely move and am in soo much pain, Im larger. I was wearing my seat belt as were the kids but I still hit the stearing wheel and really got banged up. Hit my head on it too. NO AIR BAGS! They never came out!!!!! WTF???? How can I follow up with this? This is just wrong in so many ways? If anyone has advice how to move on to sue Dodge let me know. Thanks Jeanne (((email redacted)))

THIS IS A VERY POPULAR SCAM HERE WITH USED CAR DEALERS.
IF YOU BOUGHT YOUR VAN USED OR EVEN IF YOU BOUGHT IT NEW AND YOU EVER LET SOMEONE WORK ON IT OR LEFT IT UNATTENDED FOR ANY REASON, IT IS ENTIRELY POSSIBLE THAT YOUR AIR BAGS WERE RIPPED OFF AND YOU WOULD NEVER HAVE NOTICED ANYTHING AMISS JUST BY LOOKING.
THIEVES STEAL THEM AND CAN GET $89 - $90 EACH ON THE STREETS HERE. FOR THEM. IT IS FAST CASH AND THE OWNER OF THE VEHICLE NEVER KNOWS THAT THEY ARE GONE.
IF I WERE YOU, I WOULD LET SOMEONE LIKE LEMON BUSTERS OR OTHER VEHICLE INSPECTION SERVICE LOOK AND SEE IF THE AIRBAGS WERE EVEN STILL THERE AND THAT NO ONE HAD STOLEN THEM. ONLY AN EXPERIENCED MECHANIC CAN TELL.
THEN I WOULD START TRACING THE CHAIN OF CUSTODY BACKWARDS AND PROBABLY NOT EVEN THEN WOULD YOU BE ABLE TO PROVE WHO TOOK THEM.
YOU MIGHT HAVE TO PAY TO REPLACE THEM.

First it is good that you are okay. However, the description of your injuries don't seem to match how much damage you are claiming. Because if all you came out with is some bruises when the front end is "like an accordian", it does not seem to match.
Now, the Airbags do not deploy in every situation. They deploy based when they sense a set amount of deceleration, and several other factors such as angle of impact. So it is possible that you did not have a quick enough stop to cause them to deploy. This is where the police investigation will probably help you determine the speeds and situation of the accident. This is the first thing you would have to check on before you decide to "sue" anyone.
Now, if you did sue not sure what you would be expecting. Because the airbags would not have kept the accident from happening. They would not have minimized the damage to the other vehicle or yours. So you are really left with your injuries and "pain and suffering". For the injuries you would have to show that an airbag would have kept them from being as major as they were. However, the most serious injury seems to be with your son and his "eye trauma". Without knowing the exact situation it is hard to say if that injury would have been prevented or minimized if the airbags deployed. As for "pain and suffering", that is totally objective and you would have to show that you have more pain from the accident because they didn't deploy. But with the level of injuries you described here, you would have a very hard time with that.
