On December 12th, 2009 my wife and I stopped by Doral Buik Pontiac GMC in Miami, looking to trade in our car for a newer model. They pointed out to us a car that we test drove and liked. After the dealer agreed to the trade in, the finance department searched and found a financial institution that approved us for the loan.
After we greed upon a $ 3500 down suggested by the dealer, the finance director then showed us were to sign all pertinent documentation such us financing and purchasing agreements. Once we were done, the dealer kept my wife's 2005 pathfinder as a trade in and we drove off in a 2007 Tahoe. Four (4) days later the dealer calls us to let us know that tha financial institution had approved a lower interest rate, from 9% to 7.5% so new documents were signed to reflect the new rate.
Toward the end of the month, Car Max, the lien holder of the Nissan Pathfinder, called us claiming payment . We explain to them that we no longer owned the vehicle for we had traded it in. We contacted and told the finance director at the dealer what had happend. He told us not to worry , he would take care of it.
On January 21st, 2009, 40 days after closing the deal, the finance director calls us demanding we return the car back to the dealer since financing had fallen through. So we did. We returned the Tahoe and they gave us back the keys to the Pathfinder, which was still in the lot. When we asked for the $3500 we put down, a check for $ 332.91 was given to us.
We were charged $ 49.95 a day x 40 days that we had the Tahoe, $ 959.91 for reconditioning the trade (Pathfinder), and $210 for detailing required upon return of the vehicle back to the dealer.
As a consequence of their failure to payoff the amount owed on the trade, as they had agreed, my wife's credit was ruined. They failed and neglected to find financing on a reasonable amount of time .They failed to persuade us on this situation for it to be avoided . We feel that we have been defrauded of the deposit monies for the purchase of the 2007 Tahoe.
