In 2006 after receiving my credit report as I do every year I noticed a collection agency AFNI for the amount of 78.96. After calling AFNI I learned in fact Dish Network sent me to collections for unpaid service. The address AFNI said I was being billed for was foreign to me since I have never lived there nor knew anyone who did.
I recalled using Dish network in 2001, although I learned I was wrong, and actually used their service in 2003. I do recall signing a contract for a 12-month service. I paid for two receivers and one dish totaling $90. I owned the equipment after paying the $90. I used all 12 months of my service. I recall canceling the service because well, I moved out of state. Before I moved I donated both receivers and the dish to charity.
Now fast forward to now. I tried to contact Dish Network by phone by the woman's accent was very heavy and I asked her to send me to someone that perhaps I could understand better, and was disconnected. So I tried e-mail. I was told many times they could not find my contract or address and that I should contact the collection agency, which I did again. This time I found out the name on the contract was not my own. When I asked why it was on my credit I was told to contact Dish Network.
I found the CEO's email on RIP OFF REPORT and promptly wrote an e-mail. I requested a copy of the contract in question. After many weeks I received my original contract that was fulfilled. So I emailed back wondering what that had to do with the charges at this new unknown address, and why my name was not on the account in collection on my credit. 8 e-mails later and a bbb report, the gal I have been working with changes her tune. Now the amount in collections is actually off of my original contract. Even after she admitted that my contract was fulfilled and AFNI the collection agency gave me a different address and name.
At this point I figure the only way to prove I am right is to have them show me copies of how the bills were paid. Checks, credit cards, money orders, something with a name on it. Remember I no longer have the equipment and the collection agency is showing a different name and address being billed.
I know it's not a lot of money, but it is on my credit report and that annoys me.

If you call DISH Network (800-333-DISH) BEFORE you donate/sell/etc your receivers, they can be removed from your account. Let this be the lesson - if your receivers (and their associated "smart cards") aren't tied to your account, they will have to be added to a new (or current) account before they can be used - effectively stopping situations like this.

Dish flat out refuses to admit they made a mistake. They tell me now I have to contact all three Credit Reporting Agencies, make a police report, and fill out a Form of something to the fact my identity was stolen. It was not. Considering this is the only thing out of the ordinary on my credit report. They won't just reverse it and apologize.
So I did some investigating of my own. I contacted the charity agency I donated my equipment too. I lucked out. The first person I talked to turns out to be the one who took my equipment. Some charity huh? She explains to me she gave the equipment to her daughter and she lived AT THE ADDRESS THEY ARE BILLING ME FOR!!! The employee who gave the equipment to her daughter is very kind and not only confirmed the address, but explained that her daughter had to move out of that house abruptly. The employee was nice enough to have her daughter call me. I asked her how she had the service hooked back up. She told me all it took was her fiancs name and the serial numbers off the receivers. She says she signed nothing and was asked no further questions. She claims the bills came in her fianc's name.
So now I am at a point where I am asking for Dish Network's help in getting proof of payment or statements from the woman who lived at the address. If I can prove she at least paid once then I can clear my name. Whether Dish will help or not is the question. I don't know if I should sue the girl, Dish, or both. Dish made a huge mistake and they flat our refuse to do anything about it, at the same time, the girl could be lying. If Dish knowingly gave her service in my name I could put them through the ringer. So that's where I am at. I expect I will have to bite the bullet, pay under protest then ask them to track down who owns the receivers and dish now, so that I may claim them and destroy them. Let this be a lesson to anyone who sells or gives away their old dish equipment. DON'T DO IT!!!
