I have not received a bill from Emerge since October 2006. I've been trying to pay off this account since they arbitrarily raised my interest rate to over 30% (apr), but the more I pay, the further behind I seem to be getting.

In October, they sent their last bill to me. I paid it within a few days of receiving it. I have not received a bill since then. Now, and for the last four days, I have been getting harrassing phone calls threatening collection activities, credit damage and wanting to gain access to my bank account information.

I have requested a bill each time, because I pay according to the invoices I receive. They have not offered to send a bill, except the last call this evening, when she said it would cost an additional $5.00 for a "duplicate" bill. I have never received a bill.

The last bill was due on the 20th of the month. The calls began on December 1st. I have not used the card for nearly a year, yet the balance continues to go up with their random assessments of late charges (my bills are paid and sent in a timely manner) and this new APR, up from 19% to over 30% since I stopped using the card and began to make significant payments to pay this card off.

In the last six months, I have made significant progress in paying off other credit cards; Emerge being the only problem I have had in paying off my cards. Now they are calling daily, demanding payment on a debt they refuse to show proof of.

As an aside, I have read of many accounts from others, who are having the exact same problems at this web site: I'm comforted in seeng I am not alone. I have found MANY people reporting the exact same circumstances as what I find myself in.

At this rate, I will never be able to get this card paid off and my credit worthiness will be ruined. I will not pay a bill without an invoice of what I am paying for. I will not provide any other financial (personal) information to this company. I never signed on to have this credit card.

Originally, I had another card that was bought/sold to Emerge. I do not want this card and just want to get out from under this avalanche. Can anyone please help me?

I also sent this complaint to the FTC Bureau of Consumer Protection Consumer Response Center . I would recommend anyone else having problems with Emerge VISA to do the same.

I am also considering a note to the Senate Banking committee and the Department of Justice. Usury laws aside, I believe what Emerge is doing is at the least unethical, and at the worst, illegal. I think they need a good ol Senate investigation to cool their jets a bit.

They repeated my address to me, and by the number of call I get, they have my phone number.

The burden of proof is always on the sender to verify the PO didn't lose it. They offer no proof the bill was sent. They want my banking information so they can make direct withdrawals from my account...NO WAY!

Judging from other complaints I've read here about them, this is a systematic issue with Emerge.

I am currently gong through the process provided by the FTC to resolve this issue.

I suppose your statements could get lost in the mail. I received an email from a company today asking me to call and confirm my mailing address. After I confirmed the sender and the telephone number given in the email, I called and them told me that some items had been returned to that company by the USPS marked "no such address" or whatever. I had to visit the local PO and talk with the PM about it. The PM thought that a route temp may have made an error and the regular route delivery person, the PM and the route temp will hold a follow up tomorrow.

It seems that every time a new UPS driver is assigned to this area my address is tagged with "no such address" even though UPS had been here many times before.
